The Issue
We are urgently demanding that Tucson City Attorney Roi Lusk drop the charges against a beloved dog named Snuggles, who has been held in a isolation kennel by the Pima Animal Care Center (PACC) for over 7 long months. Should have been 10 day quarantine,
Pima County is violating its own code (section 6:04.150 by ordering the death of a puppy over a clearly provoked, defensive reaction. Code they are breaking is 6.04.150 and the state law ARS S 11-1027, You can look them up,
This is a shocking bureaucratic overreach. Snuggles was startled, blind sided, and totally scared from behind in his own home. Under Arizona State Law (ARS S 11-1027), reacting defensively to being provoked and startled from behind is an absolute statutory defense. Under Arizona Law i just mentioned states a dog that is startled from behind is legal provocation, meaning he did not do anything wrong. The victim was owners, mother. She is not mad, and is begging for the city to send him home, she said she feels totally safe around him. They are also breaking the law 6.04.150, a dog would have to have bitten, injured or attacked "without provocation".
The victim in this case was the owners own mother, she is fully cooperating with the defense, and has explicitly told the city that she caused the accident by startling him. She does not want Snuggles punished .
Despite a cooperating victim, and despite the owner posting a massive $15,000 cash bond to secure his case, the City Attorney's office continues to drag this out, racking up fees and keeping a family pet locked away as a "court exhibit". Recently, county officials even started using past-tense language, calling them the family who "owned Snuggles, raising terrifying questions about his safety.
We demand that City Attorney Roi Lusk immediately sign a Stipulated Release Order ,
recognize ARS S 11-1027, and return Snuggles to his family where he belongs.
