The Court of Appeal today turned down Siyanda Mngaza’s leave to appeal today. The Court accepted the new evidence brought forward by Siyanda’s legal team Michael Mansfield QC and Virgo Consultancy Services Ltd, which proved that one of the key prosecution witnesses had stamped on Siyanda’s face, contrary to the evidence of this witnesses at the original trial.
The Court pointed out that the previous legal team representing Siyanda at the initial trial had failed to secure expert witness evidence in relation to this aspect of Siyanda’s defence.
Whilst the Court congratulated the current legal team for the care that they had taken in presenting their work, their decision was that the new evidence did not, in their view, materially change the validity of the original jury’s verdict.
The fight for justice for Siyanda continues and the legal team are now exploring further options for an appeal to the Supreme Court.
Lee Jasper campaign spokesperson said,
“We now know one of the key witnesses at the original trial was in fact lying and was involved in the physical attack on Siyanda. Although the Court accepted this, it wasn’t sufficient to render the verdict unsafe. We live to fight again.”
Cammilla Mngaza Siyanda’s Mum said,
“I am devasted. I stand by Siyanda’s innocence. We made some progress, and we will continue to fight to clear Siyanda’s name. I ask that people continue to support the free Siyanda campaign.”
The family are calling for anyone who was at the Ancient Briton campsite on or around 11 pm on the 25th May 2019 and who may have witnessed any part of this incident, please contact Virgo Consultancy services on 01446 749330
End.
Lee Jasper is available for an interview. Cammilla Mngaza will not be doing interviews at this time.
Siyanda suffered a serious racial assault and we will not rest until Siyanda is free.
We went to the High Court today with a mountain to climb in light of the failures by Siyanda’s previous legal representatives which were acknowledged by the Court of appeal. We made great progress in proving that the original prosecution case was flawed and we are grateful that it has now been accepted that Siyanda face was stomped on by one of her assailants and we now demand he be arrested and charged. We do not name him here but the Court transcripts will do so in the fullness of time.
We fight on in pursuit of Justice for Siyanda.
