Mr Bill Shorten                                                                                              Leader of the Opposition

Petition To:    All Hon. Senators and MP’s

Dear Parliamentarian,

We are proud to confirm over 115,000 Signatories have signed this petition. In Parliament, it has already secured a commitment from the Minister of Foreign Affairs and Trade; Ms Marise Payne MP and we will be expecting the new government’s Parliamentarian’s followup after the May 18 election.

The confronting imagery of Julian Assange being forcibly removed from political asylum was extremely disturbing. Apparently, a process of entrapping investigative journalists in foreign consular establishment to permanently silence them is a very real danger these days.

Is it fair to say? The evidence shows a possible breach of international law in relation to the apparent co-ordinated entrapment of a political asylee. Entrapped by the nation that provided political asylum (Ecuador) in coordination with the actual nation (USA) for which Julian Assange required protection from. Particularly in light of the actual emergence of the USA extradition order immediately on his forcible removal from political asylum.

Searching for positives from this otherwise disturbing situation, brings us to the vindication of Julian Assange’s claims of the existence of an extradition order from the USA to permanently silence him. This was always Julian Assange’s claim at least as far back as 2012 and was always his excuse that prevented him leaving the embassy to address other legal matters. This infact also further validates this petition’s urgent request that the Australian Government focus to protest and prevent the USA extradition.

It is important to formally acknowledge that signatories have in fact informed all 226 sitting parliamentarians on 33 previous occasions from as far back as July 2018 that an extradition order to the USA existed. However, according to Senior DFAT official claims the Government was not aware of any criminal charges in the USA. In this extract we see Mr James Larsen (Senior Legal Advisor of the Dept of Foreign Affairs and Trade) reply to the question on Feb. 21, 2019.

“Senator WHISH-WILSON: …. Is the Australian government aware of criminal charges against Mr Assange in the United States?

Mr Larsen : The Australian government is not aware of that, no.” (Feb. 21, 2019) Source:https://parlinfo.aph.gov.au/parlInfo/search/display/display.w3p;db=COMMITTEES;id=committees%2Festimate%2Fa08a4138-185a-434a-b512-740ee20bdb87%2F0002;query=Id%3A%22committees%2Festimate%2Fa08a4138-185a-434a-b512-740ee20bdb87%2F0000%22

How can it possibly be that Signatories knew of the extradition order through their updates, yet the “Government” apparently had no idea? To confirm I have personally sent each and every Australian Parliamentarian upto 33 individual notices with this information included. I can confirm that I personally have received 1000’s of email confirmation of delivery notices from the Australian Parliament email server accounts of all 226 Australian parliamentarians. These confirm that recipients received the notices with specific reference to the USA extradition order.

Let us make it absolutely clear and as previously mentioned: Signatories to this petition hold the Australian Government accountable for the return of freedom as well as the welfare of Mr Julian Assange. He is an Australian Citizen and for over 8 years the Australian Government has not fulfilled its obligation to uphold the most fundamental human rights of its Citizen Mr Julian Assange.

So we can all move on to close this blemish on our democracy, we (115,000 of the most courageous of peace loving people/Signatories) specifically direct the Australian Government as a universal entity and regardless of upcoming electoral political outcome. That the Australian Government regardless of political affiliation, directly and universally come together as Australians and protest, block and prevent the extradition to the USA for Julian Assange. The Australian Government must do this now.

Julian Assange is a father, a son and is highly regarded by many around the world as a hero who published facts that help stop wars and exposed systemic criminality. Julian Assange is likely the most awarded and significant journalist of this time in history as well as being nominated for the past 5 Nobel Peace Prizes. Infact just this week Julian Assange was awarded “2019 GUE/NGL Award”, an award presented for Journalists in memory of the assassinated Maltese investigative journalist Daphne Galizia who was permanently silenced by way of a car bomb in 2017. It is plain, clear and obvious for all to see, that Julian Assange needs consular help to avoid extradition to the USA where he will be tortured and jailed for the rest of his life. We know what is happening as it is in plain sight.

To confirm; Signatories are requesting the Australian Government intervene in this United Nations determined case of arbitrary detention of an Australian citizen and journalist Julian Assange. Specifically; that intervention should be to secure a guarantee that Julian Assange not be extradited to the USA.

Please let us know if there is anything you require of us to do to help you to free Julian Assange. This action will also help to uphold the most fundamental pillars of Democracy by protecting the Free Press. Because to fully protect the truly free press we must all work constructively together.

Signatories will not permit this Australian citizen and journalist to be silenced or assassinated.

Yours Faithfully,

Phillip Adams

Government discussion relating to this Free Julian Assange petition (at the time was 30,000 signatures) is pasted herein:

Senator WHISH-WILSON: If I have time I'll come back to that. Is the Australian government aware of criminal charges against Mr Assange in the United States?

Mr Larsen : The Australian government is not aware of that, no.

Senator WHISH-WILSON: Did the Australian government follow up with the US authorities following the mistaken publication of a document that suggested Mr Assange was facing criminal charges? Did you seek information on that?

Mr Larsen : I don't know the answer to that question. Is there a particular date that you're—

Senator WHISH-WILSON: I'll get that for you. You're not aware of that report?

Mr Larsen : Personally I'm not aware, no.

Senator WHISH-WILSON: You are not aware of any reports that he is facing criminal charges in the US?

Mr Larsen : I have seen media references to the possibility of criminal charges, yes.

Senator WHISH-WILSON: They haven't been followed up by you?

Mr Larsen : I would need to check that.

Senator WHISH-WILSON: I'll get you those details. Is the Australian government aware of any extradition request from the US to the United Kingdom?

Mr Larsen : The Australian government is not aware of any extradition request from the United States to the United Kingdom in relation to Mr Assange.

Senator WHISH-WILSON: Have you sought any assurances that an extradition notice doesn't exist?

Mr Larsen : I don't know that we've sought assurances in precisely those terms. I will check that. We have of course informed ourselves concerning the United States judicial system and asked questions where there have been references. But I don't know the precise answer to those inquiries.

Senator WHISH-WILSON: Briefly, what sorts of processes does the Australian government undertake and what sorts of safeguards are in place when an Australian citizen is facing extradition and could face the death penalty?

Mr Todd : In the case of Mr Assange and the United Kingdom, the extradition processes would be undertaken in accordance with UK law. He has a full entitlement to use every legal avenue available to him in the UK to defend his interests and pursue those matters.

Senator WHISH-WILSON: There's a petition being circulated at the moment that's got over 30,000 signatures asking for the Prime Minister to intervene and bring Mr Assange back to Australia. Are you able to comment on whether there have been any briefings that you have provided? I'm not asking for the advice. Have you provided any briefings at all to the Prime Minister or to the minister about bringing Mr Assange back to Australia?

Mr Todd : Our view is that Mr Assange is free to return to Australia at any time that he chooses to leave the Ecuadorian embassy.

Senator WHISH-WILSON: Are you saying he should be free at any time he chooses to leave the Ecuadorian embassy?

Mr Todd : If he leaves the Ecuadorian embassy, as I've said previously before this committee, he would be subject to any outstanding judicial processes in the UK. We have assurances from senior government representatives in the UK that he'll be given all due legal process. I understand that that relates to an outstanding bail matter. As Mr Larsen said at the last hearing of this committee, he has a current Australian passport.

Senator WHISH-WILSON: Are you aware of the petition that's been circulating calling for his release?

Mr Todd : I have seen a copy of that petition.

Senator WHISH-WILSON: Going back to the issue Mr Larsen mentioned about seeking assurances that an extradition notice doesn't exist in the UK, because I think this is the critical problem, you said 'not quite in those terms'. Could you elaborate a bit on what kinds of conversations you have had with the UK government about any potential extradition of Mr Assange?

Mr Larsen : I know that we have had extensive conversations with the United Kingdom government concerning Mr Assange. I will need to check precisely what discussions we have had about the possibility of a United States extradition request. I don't have that answer with me.

Senator WHISH-WILSON: Is it possible for me to seek a private briefing with you, on your indulgence, Minister, on this matter?

Senator Payne: We'll facilitate a briefing, Senator Whish-Wilson.

Senator WHISH-WILSON: Thank you.
