Thank you so much for signing Daniel’s freedom petition and sharing it.   Your efforts are succeeding!  We now have MORE THAN 25,000 SIGNATURES on Daniel’s petition.  You have achieved this milestone in time for Daniel’s birthday, December 10th.  Thank you for bringing hope into Daniel’s life on a day when he may need it most.

Three years ago on his birthday, Daniel was wrongfully convicted, ripped from the family and friends who love him dearly.  The overwhelming presumption of guilt, investigators’ tunnel vision, and flawed DNA analysis led detectives to reverse-engineer a case against Daniel following a single allegation lacking forensic evidence. 

The nation laughed and scorned him while Daniel faced his wrongful conviction in a courtroom verdict made public for all to see.  His devastated family and friends were forced to watch as their innocent loved one was led away to a prison life where they could not follow to protect him. 

Since the horrifying and traumatic time of Daniel’s conviction, so much has happened that helps us all see light at the end of the tunnel Daniel is being forced to endure, day after day. 

After Daniel’s wrongful conviction, his family and friends created this petition directed to the Oklahoma Governor, other officials, and Oklahoma media, asking for clemency for Daniel and for an investigation of the prosecution’s misconduct, forensic science errors, and mishandling of Daniel’s case that led to his wrongful conviction.  

Journalists became interested in Daniel’s story, with Michelle Malkin being the first to dig deeply into the quagmire of police investigation errors and presumption of guilt that caused his conviction.

Lawyers voiced concern about the mob impact that deprived Daniel of a fair trial.  They also spoke out about the unconstitutional secret hearings during which – without Daniel or his attorneys being allowed to be present -- the prosecution discussed the personnel records of their forensic analyst who had made numerous errors in her testimony, misleading the jury. 

The secret hearing’s judge -- the same trial judge who gave Daniel 263 years of prison time to be served consecutively -- claimed there was nothing wrong or prejudicial with the testimony of the State's forensic analyst.

But six eminent scientists from around the world, including world-renowned forensic expert Dr. Peter Gill, have concluded there were severe problems with the investigation and forensic analyst’s claims. 

They describe their findings in the “Report on Scientific Issues in the Case of Oklahoma v. Daniel K. Holtzclaw by an International Panel of Forensic Experts,” released publicly at www.HoltzclawDNAreport.com

The scientists noted that the prosecutor grossly mischaracterized the DNA evidence when he misled the jurors by telling them it was a “fact” that DNA transferred in vaginal fluid to the fly of Daniel’s uniform pants.  In reality, no evidence of any body fluid was found.  The mixture of low level DNA including male DNA has an innocent explanation:  the transfer of skin cell DNA via Daniel’s hands during the everyday actions performed by police officers, including pat-searches, checking belongings for drugs and weapons, and going to the restroom by unzipping the fly of their buckled uniform pants.

After reviewing the forensic documents and testimony, the forensic experts concluded: 

“We believe that Mr. Holtzclaw was deprived of his due process right to a fair trial because the State misused DNA evidence – a powerful form of forensic evidence – and trial defense counsel did not correct crucial forensic science misrepresentations and omissions, such that the DNA evidence at the heart of the trial and lacking probative value was extremely prejudicial, corrupting the investigation of Mr. Holtzclaw and impacting the verdict.  We believe that Mr. Holtzclaw’s conviction should be overturned and he should be given a new trial.”
