FORMAL PETITION FOR REVIEW AND CONSIDERATION OF REMOVAL
Thomas (Tom) Roy — State Street Corridor Improvement Authority Board
To: Saginaw Charter Township Board of Trustees
Saginaw Charter Township, Saginaw County, Michigan
Re: Petition for Review of Appointed Board Member Thomas Roy Pursuant to MCL 125.4204
We, the undersigned residents, taxpayers, and concerned members of the Saginaw Township community, respectfully petition the Saginaw Charter Township Board of Trustees to initiate a formal review of Thomas (Tom) Roy's continued service on the State Street Corridor Improvement Authority (CIA) Board and determine whether sufficient cause exists to warrant his removal.
I. STATEMENT OF PURPOSE
Public service, whether through elected office or appointment, carries an obligation to act with integrity, transparency, accountability, and in the best interests of the community.
Membership on the State Street Corridor Improvement Authority Board is a position of public trust. Its members participate in decisions affecting economic development, public resources, and the long-term interests of Saginaw Township residents and businesses.
Public confidence in those decisions depends upon the integrity, independence, and accountability of the individuals entrusted with making them.
We believe that concerns regarding Mr. Roy's public activities, organizational leadership, potential conflicts of interest, and conduct in relation to community affairs warrant an impartial review.
This petition does not presume wrongdoing. Rather, it requests that the Township exercise its oversight responsibilities and determine whether Mr. Roy's continued appointment remains appropriate under applicable law.
II. LEGAL AUTHORITY
Michigan's Recodified Tax Increment Financing Act, specifically MCL 125.4204(4), provides for the removal of an authority board member for cause by the governing body of the municipality, following notice and an opportunity to be heard.
We respectfully request that the Township Board consider its authority under this statute and any applicable local ordinances, bylaws, ethics policies, and appointment procedures.
III. REQUESTED ACTIONS
We formally request that the Saginaw Charter Township Board of Trustees:
1. Initiate an independent and documented review of Mr. Roy's service on the State Street Corridor Improvement Authority Board, including attendance, participation, official conduct, and compliance with applicable ethical obligations.
2. Examine potential conflicts of interest, including any relevant financial, organizational, or political relationships that may intersect with matters considered by the authority.
3. Review applicable public records, including meeting minutes, financial disclosures, voting records, and any documented complaints relevant to his official duties.
4. Determine whether legally sufficient cause exists for removal under MCL 125.4204(4), applying an objective and consistent standard.
5. Provide a written public response explaining the Township's findings, any action taken, and the applicable legal basis for its decision, subject to lawful confidentiality requirements.
6. Initiate the statutory removal procedure, including proper notice and an opportunity to be heard, if the evidence establishes sufficient grounds.
IV. PUBLIC ACCOUNTABILITY
An appointed position is not an entitlement. It is a responsibility entrusted to an individual for the benefit of the public.
The residents of Saginaw Township deserve confidence that those serving on public authorities are held to appropriate standards of transparency, ethical conduct, and accountability.
We recognize that political disagreement, lawful advocacy, or differences of opinion do not, standing alone, constitute legal grounds for removal.
Our request is for a fair, evidence-based examination of official conduct, not punishment for protected speech or political association.
V. FORMAL REQUEST
By signing below, we respectfully request that the Saginaw Charter Township Board of Trustees acknowledge this petition, place the matter before the appropriate governing body for consideration, and determine whether further investigation or removal proceedings are warranted.
We petition for accountability, transparency, and due process in the administration of our local government.
PETITION SIGNATURES
By signing, I support the request for a formal review of Thomas Roy's appointment to the State Street Corridor Improvement Authority Board. My signature does not constitute an allegation or finding of misconduct.
This is a citizen petition requesting governmental review, not a statutory recall petition or a determination of wrongdoing. Signatures do not independently require removal or establish cause under Michigan law.
