I am writing because I'm very concerned about my sister Morag Walsh. Her husband John Walsh was killed whist working constructing a golf course outside of Beijing in China. The golf course had two companies involved in its construction. One an American company called Flagstick, the other a Chinese company called Pan China Sports. John was hired by the project manager for FLAGSTICK, (Tim Zirkle) but supposedly Pan China was to pay his wages. John's widow and child have not yet received compensation from either company. The Chinese company is in the process of offering compensation to a maximum figure of US$50,000. John was killed on the first day working for Pan China (the company which worked alongside Flagstick AND it was Flagstick's project manager who offered the work to John in this instance.) attempts to contact Tim Zirkle have been fruitless. There is no contract available showing evidence of which company employed John, initially both companies denied employing him. John and the bulldozer he was operating ended up in a lake on the site. The bulldozer was found with its lights on in the lake and John's body was discovered in the lake at a later time. There were no barriers or warning signs regarding this hazard on the course. The lack of barriers was witnessed by John's brother when he flew to China to arrange to have John's body flown to his hometown for burial. There was no autopsy performed and the mobile phone he used shortly before his death was not retrieved. My sister had been told that the courts will not release more details unless she mounts a law suit, which she cannot afford to do. The death occurred in November last year. No American lawyer she has approached, so far, has felt they can be of assistance due to the lack of paper evidence in this case. The Chinese company are offering compensation of approximately US $50K, this amount does not even close the gap between the $252000 mortgage on her house and the $195000 value of her home, (due to GFC), she will be left with nothing. Her husband was only 39, they have a 12 year old son and my sister, an American Citizen is 54. She is trying to get into the work force but the future is very insecure for her. Our 84 year old mother has refinanced her home to help support my sister and her son. I believe Flagstick is involved in a number of courses in China. I can't help feeling that they have some duty of care as their employees are also working on this construction site with poor safety ethics . Also it was FLAGSTICK's project manager who secured John's employment. (even though according to the Chinese company, they are the ones to offer the compensation.) Initially they denied employing him and seemed to blame the American company. US$50000, it seems so little compensation for the negligence that caused John's death. Surely John's life is worth more. All his family want is security. Please ask Flagstick to show some compassion to my sister and her son and give her a compensation payout which will help secure their home. Thank you. Ann Gilchrist.
