Thank you for your prior correspondence regarding Proposition 19 (2020) that contained a massive tax increase on property that is transferred between parents and children. I appreciate hearing from you as I am writing to give you an update.
I strongly opposed Prop. 19 last year and co-authored the ballot argument against it, which you can find on pages 42 and 43 at this link: https://vig.cdn.sos.ca.gov/2020/general/pdf/complete-vig.pdf Unfortunately, Prop. 19 passed by a very small margin.
As you may know, I authored Senate Bill 668 this year that would delay the implementation date of a provision of Prop. 19 to February 16, 2023. I hoped some legislators who supported Prop. 19 last year would have supported my bill to give some relief to middle class families who do not want to sell their long-time homes due to higher tax bills.
Unfortunately, even a two-year delay was a bridge too far for the Legislature’s majority party. The Senate Governance and Finance Committee heard SB 668 on May 7, 2021, but did not vote on it. The committee’s chair pledged to work with me on addressing the issues that many families are facing due to Prop. 19.
The committee’s chair and I were unable to come to an agreement and SB 668 is essentially dead due to a lack of support from Senate Democrats.
The fight regarding Prop. 19 is not over. I support Assemblymember Kevin Kiley’s Assembly Constitutional Amendment 9 that would restore what Prop. 19 took away: the constitutional exclusion from reassessment when certain property is transferred between parents and children or grandparents and grandchildren. Should the Legislature refuse to pass ACA 9, I hope Californians will support grassroots efforts to overturn Prop. 19’s worst consequences at the ballot box.
