Proposition #19 was passed this last November.  It was sponsored by the California Realtors and brought about two good things:

#1. People who had their homes destroyed in a fire, earthquake, flood, etc. could keep their low tax rate and rebuild.
#2. People over 50 could move three times and retain their prior low tax rate.

However, something slipped into the bill, and kept pretty quiet was that you NO LONGER could will your home to your child or grandchild, and have them keep the low tax rate of the dwelling.  Now, with Prop 19, the property will be reassessed to the current value and your child or grandchild will pay that tax. Most properties would have their tax rate raised so disastrously, that the child or grandchild could not afford it, and the only option would be to sell the property. Perhaps your son or daughter wanted their childhood home and now could no longer afford it? Perhaps your grandchild’s only option is to sell a home that had been in your family’s possession for generations?  It won’t matter - most probably the home would have to be sold, as the new tax base raises the cost of living, for that property, multiple times over.

Of course, forcing a dramatic increase in home sales is a huge benefit to realtors - which is why this was not stressed when Prop 19 was written and advertised.  Many understood this, and voted NO, but many didn’t realize what they were voting for, and it passed by a narrow margin.  Urgently, we need to convince our California legislators to pass a revision to Prop 19 to eliminate this section that is so damaging to your children and grandchildren.  Please sign the petition, below, and pass it on to your friends and family!

Also - please write a short note to your local legislators, stating that you will be harmed by Proposition 19 when trying to leave your property to your child or grandchild, and you demand that section be overturned.  Your legislators can be found here, by entering your address:
