On Sept. 2, 2012, the two boys were outside practicing archery, when our dog Bear was behind our house getting a drink of water from the pond. A few moments later they witnessed their Uncle David Thomas shoot Bear from about 5 feet away. They heard Bear squeal, so their first instinct was to run towards Bear while he was running back towards the house in which David proceeded to shoot a second time, not only missing Bear, but also shot towards the two boys. When Bear was shot David and Bear were both standing on our property. We contacted the Kentucky State Police three times before they would even come out and investigate the matter. While waiting for the police to show up we started searching for a vet to take Bear. After 2.5 hours Officer Wagner showed up and talked to the boys, the father (Rick) and the mother (Kim). Officer Wagner told us that there was nothing he could do and that we needed to go to the courthouse and file a Civil-Suit. Officer Wagner also proceeded to inform us that the only reason he came out was because the other party was making a lot of phone calls saying it was a family feud. On Monday Sept. 3, 2012 we were told that Bear did not make it through surgery, and the bullet was found in the lung cavity. They said that Bear's death was caused by a collapsed lung and internal bleeding. So, on Tuesday Sept. 4, 2012 when the courthouse opened back up we went to file a complaint against David. A week later Rick was told that it would go in front of a grand jury on Sept 21, 2012 and Cecil Watkins handed the case over to Ronnie Goldy. We later found out that the case was presented to the grand jury but they couldn’t indict because it was filed under the wrong charges. It was filed under the charge of cruelty to animals in the first degree as dog fighting. (KRS 525.125) The charges should have been torture to a cat or dog. (KRS 525.135) The two boys are at the age where they trusted these people that are in an authority position. But after realizing that they just keep dragging their feet they no longer trust them. We have always taught our children to tell the truth, and obey the law. But what kind of an example are these people in the authority positions setting for my kids when they continue to lie to my family.
