Healthcare Profession on Trial
As a GP Trainee Doctor/Registrar, I have been subjected, with many other clinicians, through the Professional Services Review Program, questioned and interrogated by the Department of Health about my previous Medicare Billing.
Along with two previous senate inquiries, and numerous attempts to contact relevant authorities, associations, colleges and the Federal Health Minister himself about the injustice and inconsistency of the current Medicare Audit system, we have been ignored.
In order to protect a sustainable patient and provider relationship, I have now lodged a Federal Court case and have successfully defeated the Government's multiple attempts to strike me out.
Myself and my brilliant team (QC Julian Burnside, Mr. Jerry Prus and Mr. David Gardner) are facing Goliath on the 1-3rd of April 2020 for an Epic three day trial.
I am not seeking compensation or damages, I just seek an open transparent and accountable healthcare system:
1) Is it fair and just for healthcare workers to be interrogated and penalized for Medicare billing when there are:
*no access to agreed peer reviewed standards
*no access to previous case deliberations and findings
*no education given regarding Medicare billing
2)Is it legal that clinicians are not afforded legal representation during these interrogation and no opportunity to appeal a decision on merit of the case?
3)Do you think that if your professional body is legally conflicted they are in a position to represent you?
4)Is it legal to allow government organisations to have access to patient records for interrogating clinicians without patient consent?
5)Is it fair for a trainee Doctor to be put through this process and for their supervisors to be exempt from any penalities?
Just by simply asking these questions in a Federal Court, the first 'response' I received from the Government in 2018 was threats of cost orders and financial/professional ruin if continue to pursue the case.
Despite these threats, my family and I stood our ground and now we finally defeated their attempt to silence us and we are going to trial.
I feel it is important to get a fair hearing as I feel this is our duty to our patients.
To do nothing will be complicit.
What I need from you is to show that it is not just myself that feels there are significant flaws in our healthcare system. I also need you all to support and finance the trial as my medical indemnity insurer will not support these cases.
It needs to be more transparent, open, and accountable for both patients and providers.
