SHUT DOWN THE SPACEX BOCA CHICA LAUNCH RANGE

The Issue

WHEREAS,

Space Exploration Technologies Corp (herein SpaceX) has established a rocket testing range in Boca Chica Village, Texas, through accommodations in Texas State Law, and

That range is located between Boca Chica State Park to the West, Las Palomas Nature Management Area to the South, and beaches used by endangered sea turtles to the East, and,

Environmental assessments conducted by the FAA prior to state approval (https://www.faa.gov/about/office_org/headquarters_offices/ast/environmental/nepa_docs/review/launch/spacex_texas_launch_site_environmental_impact_statement/media/Final_BO_FAA_SpaceX_sm.pdf not only restricted the size, type, and frequency of launches from that site, but also identified many endangered species living in these areas including:

  • Endangered Ocelot
  • Endangered Gulf Coast Jaguarundi
  • Endangered Northern Aplomado Flacon
  • Endangered Kemp's Ridley Sea Turtles
  • Endangered Hawksbill Sea Turtles
  • Endangered Leatherback Sea Turtles
  • Threatened Green Sea Turtles
  • Threatened Loggerhead Sea Turtles
  • Threatened Piping Plovers
  • Threatened Red Knots

And,

SpaceX has thus far only used this site for destructive testing, including their test flights SN8, SN9, SN10 and SN11 which launched 3/30/21 midair causing a much larger shrapnel field that contaminated area outside the launch zone,

We the undersigned call on the Federal Government and the FAA to immediately shut down SpaceX operations at the Boca Chica facility, empowered by the following:

SpaceX has never had State authority, licensing, or permits to conduct destructive testing at this site;

Their allowance, as written into Texas State Law, is for one launch per month, on weekdays not including holidays, between the hours of 7am and 7pm;

And, those approved launches were for the much smaller and proven variants of the Falcon 9 and Falcon Heavy spacecraft, not for test articles of any description that have a high expectation of and capacity for destruction.

This FAA environmental assessment was released in December 18, 2013 and pre-dates all mention of the StarShip. There is no way the FAA could have anticipated this environmental review and attached approval would be abused in such fashion as to allow multiple launches every month that have all ended in explosive failure. One test article caused a 100-acre brush fire last year.

We call upon the US Federal Government, Texas State Government and the Federal Aviation Administration to act according to their own laws and recommendations; and, we task GREENPEACE INTERNATIONAL to take up this fight through court actions and blockades to ensure the native and endangered species in the area, as well as the area itself, is once again protected and free from such destruction caused by SpaceX.
