Families Across Henderson County Seek Accountability from UT Health

The Issue

We are Marion and Kenneth Scott from Murchison, Texas.

 

In July 2025, our baby girl Penelope was injured in a co-sleeping accident. She fell from the bed, and we immediately sought medical care. Despite a clear medical history, documented injuries consistent with a fall, and no suspicion of abuse from any doctor, CPS opened a case against us after we tried to hold UT Health Athens accountable for failing to identify her fracture during the initial visit.

 

When we reached out to Governor Abbott’s Office and Representative Robert Nichols’ Office for oversight of the CPS investigation, the allegation suddenly changed — from neglectful supervision to suspected abuse. This shift happened without any new evidence and after multiple medical professionals confirmed the injury was not abuse.

 

This is not child protection — it’s retaliation.

Why This Matters:

 

Medical documentation from UT Health Athens, Lakeland Medical, and Scottish Rite Hospital all clearly state the cause of injury was a fall.

 

Not one medical provider documented suspicion of abuse or neglect.

 

CPS escalated the allegation only after we requested accountability and oversight.

 

Our children have already been through enough — these intimidation tactics add unnecessary trauma.

 

 

If CPS can target a family for speaking up, it can happen to any family in Texas.

1. An immediate review of our CPS case by independent oversight.

 

 

2. Accountability for UT Health Athens for failing to diagnose Penelope’s fracture during the first ER visit.

 

 

3. Policy protections for families who request oversight, to prevent retaliatory action from CPS.

Since launching this petition, we’ve obtained and reviewed all of Penelope’s medical records. Every provider documented that her injury was caused by a fall. None documented abuse.

 

Yet CPS has ignored these facts, chosen to escalate the allegation, and has continued to keep our family under investigation. This is further proof that what’s happening is retaliation, not protection.

 

We will not stop fighting for our children, and for a system that treats families with fairness and dignity.
