To the Honorable Court:
I respectfully submit the attached Petition for Expungement, Affidavit in Support, and
supporting documentation pursuant to 13 V.S.A. § 7602 and § 7606, in the matter of State v.
Justin-Ames Gamache, Case No. 1127-10-13 Bncr.
As detailed in my affidavit, I was convicted solely of a misdemeanor offense of Impersonation of
Officer, which does not fall within any of the exclusionary categories defined under 13 V.S.A. §
7601(4). Furthermore, it is not a predicate offense, as explicitly defined in § 7601(3), and any
prior determination to the contrary was made in error.
The Vermont Supreme Court, in State v. Justin A. Gamache, 23-AP-019, indicated that such
an error may be grounds for reconsideration. In light of that ruling, I now respectfully renew my
request for expungement under the law.
The requirements of § 7602(b) have been satisfied in this case, and the record should be
expunged in accordance with § 7606. I respectfully request that the Court issue the appropriate
order, and that all associated records be sealed or destroyed as prescribed by law.
