EY GLAS fraud | Save BYJU'S, Save OUR Jobs, Remove Shailendra Ajmera as BYJU'S RP
The Issue
We are a collective that represents the employees of BYJU’S and its companies. It is with great anguish and anger that we DEMAND the immediate removal of Shailendra Ajmera, a FRAUD partner at EY India, from the position of Resolution Professional (RP) overseeing the ongoing insolvency process of Think & Learn Private Limited (TLPL), the parent company of BYJU’S. The insolvency process that has been secretly run by EY for GLAS is biased and criminally tainted, effectively trying to burn down our company and our future.
Why are we raising our voices?
A recent whistleblower email from an EY employee has exposed serious misconduct in the insolvency process, revealing that Dinkar Venkatasubramanian, who leads the Debt and Special Situations practice for EY India, has been criminally conspiring and covertly running the insolvency proceedings on behalf of GLAS Trust. This has reduced India’s insolvency law (IBC, 2016) to a mere sham, allowing vested interests to manipulate the process to their advantage.
The whistleblower email contains concrete proof of criminal collusion between GLAS, EY India, and the previous Interim Resolution Professional (IRP) Pankaj Srivastava, who was recently reprimanded by the NCLT for his irregularities in handling TLPL’s insolvency. We received the email two days ago, and we are coming together as an employee union after this big expose which shows how criminally we have been denied our basic salary rights by this evil nexus between a group of foreign lenders , EY India & RP. We are reaching out to the wider world directly. WE DEMAND JUSTICE
What is GLAS Trust and why does it matter?
GLAS Trust has filed multiple frivolous cases against BYJU’S across various Indian legal forums. But it has not yet established its position as the bona fide representative of BYJU’S US lenders. Despite having no legal standing in the insolvency proceedings of BYJU’S India assets, GLAS was still admitted into the Committee of Creditors (CoC) by Srivastava who was a pawn in the game for EY and Glas.
Whistleblower evidence shows that Srivastava handed over all of BYJU’S credentials to Dinkar from EY on Day 1 of the insolvency process, effectively granting GLAS complete control over the company. EY India facilitated this, acting in blatant conflict of interest. THE ENTIRE PROCESS IS RIGGED
Why are we in pain?
First and foremost, we are unable to serve our students, who had to go for their exams without preparation. We are unable to pay our rents and EMIs because we are not being paid our salaries. The IRP, under the influence of these foreign lenders & EY, stopped paying our salaries. They blocked us our basic right. We cannot let this continue. Thanks to the rigged insolvency process. Most of us are women, who were teaching remotely and effectively. By trying to kill BYJU’S, they are also killing the households of thousands of teachers. Save us. Second, Aakashians are witnessing their company, India’s largest classroom-based coaching business, being unnecessarily harmed by GLAS, which falsely claims ownership over Aakash.
We have so far watched this injustice from the sidelines. We have seen our colleagues suffer. We know there is a clear path to recovery. All we ask is a fair chance to rebuild what we have worked so hard to create.
What do we demand?
We demand the immediate removal of Shailendra Ajmera from EY India as the new RP of TLPL. His appointment is nothing but an attempt by GLAS to install a proxy for Dinkar Venkatasubramanian, ensuring complete control over the process. This is unacceptable.
We will not allow American financial predators to destroy our company and trample our livelihoods.
We are sad. We are angry. But we are still working.
