Establish the Texas Office of Parental Rights: From Constitutional Promise to Enforceable
The Issue
Thank you to everyone who continues to stand with us in demanding fairness, transparency, and accountability for Texas families.
Our movement is part of a broader, statewide effort to ensure that the fundamental rights of parents are protected not just on paper, but in practice.
Following the passage of Article I, Section 37 of the Texas Constitution, parental rights are explicitly recognized as fundamental. However, parents across Texas still face enormous administrative hurdles and bureaucratic resistance when trying to exercise those rights—with no centralized support system to turn to.
Policy experts and legal scholars are highlighting this exact gap. In a policy paper published on September 2, 2026 ("Toward an Office of Parental Rights in Texas" by Noah Torres), scholars emphasize that centralizing the enforcement of parental rights is essential to bridging the gap between constitutional guarantees and real-world protections.
The Solution: A Dedicated Texas Office of Parental Rights
To give Article I, Section 37 real legal teeth, we are advocating for the creation of a dedicated Office of Parental Rights within the state government. This agency would serve as an ombudsman and enforcement hub to:
Investigate Grievances: Provide a direct, formal platform for parents to file administrative complaints when state entities, school districts, or local courts infringe on parental authority.
Centralize Guidance & Resources: Offer clear tools and legal navigation for families attempting to exercise their rights regarding their children's education, healthcare, and upbringing.
Ensure Agency Accountability: Provide independent oversight to guarantee state entities uphold their constitutional duties to respect family autonomy.
A constitutional right without a clear enforcement mechanism leaves families fighting long, expensive, and isolated battles. Establishing an Office of Parental Rights ensures Texas backs its constitutional promise with real structural authority.
