Estabelecer acordo bilateral de tempo de serviço Brasil-Irlanda

O problema

Nos últimos anos, um número crescente de brasileiros tem escolhido a Irlanda como destino para viver e trabalhar. Um fator decisivo nessa escolha envolve o planejamento de carreira e aposentadoria. Atualmente, não há um acordo bilateral entre o Brasil e a Irlanda que reconheça o tempo de serviço trabalhado em cada país, prejudicando trabalhadores que contribuem para os sistemas previdenciários em ambos os territórios.

Um acordo de tempo de serviço entre Brasil e Irlanda proporcionaria inúmeros benefícios. Para os trabalhadores brasileiros na Irlanda, isso significaria o reconhecimento do tempo de contribuição previdenciária em empregos anteriores, e vice-versa para os irlandeses que trabalharam no Brasil. Além disso, facilitaria a aposentadoria sem penalizar aqueles que dividem suas carreiras entre os dois países.

Vários países já estabeleceram acordos semelhantes, resultando em segurança e previsibilidade para trabalhadores migrantes e suas famílias. Por exemplo, o Brasil possui um acordo de segurança social com Portugal desde 1995, beneficiando milhares de trabalhadores em ambos os lados. Este acordo permite que os trabalhadores somem os períodos de contribuição dos dois países, garantindo uma aposentadoria mais tranquila. O mesmo poderia ser alcançado entre Brasil e Irlanda.

Pedimos ao Ministério das Relações Exteriores do Brasil e ao Department of Social Protection da Irlanda que comecem negociações para estabelecer um acordo de tempo de serviço entre os dois países. Este tratado não apenas beneficiaria os indivíduos diretamente envolvidos, mas também fortaleceria os laços econômicos e culturais entre Brasil e Irlanda.

PETITION FOR THE CONCLUSION OF A BILATERAL SOCIAL SECURITY AGREEMENT BETWEEN THE REPUBLIC OF BRAZIL AND IRELAND

To the Minister of State for Foreign Affairs of Brazil,
To the Minister of State for Social Security of Brazil,

The undersigned citizens, Brazilian nationals residing in Ireland, abroad, and foreign nationals residing in Brazil, respectfully come before Your Excellencies to request the opening of negotiations for the conclusion of a Bilateral Social Security Agreement between the Federative Republic of Brazil and Ireland, based on the following:

1. Context

Brazil currently has social security agreements with several countries (including Germany, the United States, Japan, and Portugal) that ensure social protection for workers who divide their working lives between two countries.

However, the absence of such an agreement between Brazil and Ireland creates a protection gap, forcing workers to contribute as voluntary insured persons in order not to lose their rights or, even worse, resulting in the total disregard of foreign contribution periods for Brazilian social security benefits granted by the National Institute of Social Security (INSS).

2. The Agreement

The adoption of this bilateral agreement aims to implement the following key mechanisms:

Recognition and Totalisation of Contribution Periods:
To allow contribution periods completed in Ireland to be added to those completed under the Brazilian INSS, in order to meet the minimum requirements for retirement and other benefits.

Avoidance of Double Taxation:
To ensure that workers are not taxed twice on the same social security income or contributions.

Pro-Rata Payment of Benefits:
To establish that each country shall pay its share of the retirement pension and other benefits in proportion to the contribution periods completed under its own legislation.

Preservation of Insured Status:
To facilitate the continuity of social security coverage for workers in situations of temporary or long-term posting between Brazil and Ireland.

3. Social and Economic Benefits
The formalisation of this partnership, with the participation of the Brazilian International Social Security Agreements Agency (APSAI), will bring legal certainty and dignity to workers and their families, encouraging professional mobility and the regularisation of employment relationships in both countries.

Without such an agreement, periods of work carried out in Ireland are generally not considered for Brazilian social security purposes, which seriously harms thousands of individuals who have contributed to the economic development of both nations.

In light of the above, we respectfully request that the Brazilian Government, through its competent bodies, initiate feasibility studies and diplomatic negotiations with the authorities of Ireland for the drafting and signing of a Bilateral Social Security Agreement, following the model of international social security conventions already in force between Brazil and other partner countries.

We further request that, once concluded, the agreement ensure:

The possibility of filing applications via the “Meu INSS” digital platform, under the modality “International Agreement – Retirement by Contribution Time” or equivalent;

Clear procedures and documentation requirements for proving employment and contribution periods abroad (such as certificates and payslips issued in Ireland);

Reasonable processing times in the analysis of claims by APSAI and the relevant Irish authority.

Under these terms, we respectfully await a favourable response.
