The Issue

         On July 29 2014, Buffalo Narcotics officers and the SWAT team stormed a West Seneca residence on Edson Street at 6 am in the morning. The residents were sleeping with their house-dog, a nine month old pit-bull puppy named Rocky, who was beloved both in the house and within the community. Rocky had been trained and loved from the time of his birth, was very well socialized, and did not have a mean bone in his body.

         In fact, medical records show that despite the officers frightening method of entry into the residence, all Rocky did was stretch his legs at the foot of Joseph Smith, one of his owners' bed. Photos, police reports, and medical records show that two narcotics officers Detectives Joseph Smith and Shawn Adams smoked Rocky numerous times with multiple firearms from over 10 feet away as the innocent dog stretched on Smith's bed.

         For Buffalo Narcotics, it was business as usual. Public records show that Detective Cook has killed more dogs in two years than the entire NYPD combined.

         That is a fact as well as an abomination. What was gained in this brutal murder? The police found a small amount of drug residue and marijuana in the cubbies of a bedroom and charged Joseph Smith, whose dog was blown up at his feet.

         Smith’s attorney, Matthew Albert Esq., after a long legal battle, was able to get the charges against his client dismissed. Despite the thousands of dollars that have gone into this worthless prosecution, the DA has double downed to protect the dog killers and refilled the charges against Smith… going to every length to persecute Mr. Smith for allegedly possessing minute quantities of drugs, while not even peeking into the possible criminal liability of the Police for the brutal slaying of Rocky.

         Was this legal? This case is a poster child for why the war on drugs is an epic fail. Doors are kicked in, communities are brutalized, and dog’s lives are lost. Sociopaths with badges get rich based on the number of doors they kick in, regardless of what they find, who they beat or kill, and no matter the cost.

Meanwhile, District Attorney offices just smile and sign the officer’s court slips and ignore the trails of blood and tears left at these residences. Instead, they take hardline stances and merely prosecute anyone who they find to possess drug residue and marijuana.



Wash rinse and repeat. The communities are tired of this double standard and tired of police having a free pass to brutalize communities so long as they are able to put a little dope on the table, so the mayors can have their year end press conferences bragging about how many search warrants they executed, while ignoring how many people and animals they have executed.

         Please stand with Rocky and his co-owner Joseph Smith, who has already paid the ultimate price for allegedly possessing a plant. The DA does not work for the police even though they all seem to believe they do. The people ask that the murderers of Rocky be prosecuted, as opposed to the alleged and inconsequential citizens whom allegedly possessed a plant.
