The Issue

My 3-year-old daughter was recently denied an Individualized Education Program (IEP) and access to early childhood special education services. Despite being diagnosed with profound deafness in her right ear, autism, sensory processing disorder, and cerebral palsy—conditions that undoubtedly impact her daily life—she was deemed ineligible simply because her academic performance is above average. This dismissal doesn’t account for the barriers she faces, and sadly, our story is not unique.

In Missouri, many deaf, hard-of-hearing, and disabled students encounter unnecessary obstacles in receiving the education they are legally entitled to. The current system often mandates families to demonstrate academic failure before any services are provided, forcing children to struggle and fall behind before they qualify for the help they need. Such practices are not only inequitable, but they also contravene the very essence of educational fairness and inclusion.

The legislation we are proposing aims to change this unjust paradigm. We demand that the criteria for support and services be re-evaluated to focus on preemptive and preventive measures, rather than solely relying on evidence of academic struggle. Schools should be empowered and mandated to provide accommodations and interventions based on a holistic understanding of a student's needs.

Statistically, early interventions are proven to yield positive lifelong outcomes for children with disabilities. According to the U.S. Department of Education, when students with disabilities receive services early on, they're more likely to succeed academically, socially, and eventually, professionally. Therefore, it is both sensible and fiscally responsible to invest in our children’s futures now.

We also believe that transparency and accountability within the education system need strengthening. There should be clear guidelines and accessible processes for families to follow when seeking services, along with adequate support and resources readily available for those who need them.

Join us in demanding change for Missouri’s deaf, hard of hearing, and disabled students. Sign this petition to urge our state legislators to adopt this proposal and ensure equitable access to education for all children. Stand with us to make education a right, not a privilege, for every child across Missouri. Together, we can remove these barriers and pave the way for a more inclusive future.

Please sign the petition and help us support equity, access, and fairness for Missouri’s children.
