The Issue
My sister lost her son to a tragic accident. He was riding his sports bike when a driver hit him and left the scene. It took three or four agonizing days to find the driver. By then, vital evidence had diminished. Without immediate access to the driver, authorities couldn't perform a timely blood test to determine impairment. Furthermore, the driver wasn’t insured, driving someone else’s vehicle, and unjustly shifted the blame onto my nephew, merely because he was riding a bike. This is the heart-wrenching reality that compels us to act.
In Kansas, too many precious lives are being lost because drivers are inattentive to sports bikes and motorcycles. Kansas lacks strict enforcement when it comes to holding drivers accountable who flee the scene after harming a motorcyclist. We need more stringent laws to ensure justice for victims and their families. Drivers should face severe penalties for leaving the scene of an accident, which could include escalated charges for hit-and-run incidents, mandatory minimum sentences, and increased fines.
Statistics have shown that motorcyclists are 28 times more likely than passenger vehicle occupants to die in a collision, yet they continue to be sidelined when it comes to road safety and legal accountability. We cannot let potential blood alcohol and drug levels go untested due to delays like those in my nephew’s case. Implementing quicker investigative procedures and ensuring all drivers involved in accidents are tested promptly could make all the difference in legal outcomes.
The Kansas legislature must take concrete steps toward reforming these inadequate laws. Legal loopholes allow drivers involved in fatal accidents to evade accountability easily. Establishing mandatory insurance checks, driver identity verification, and real-time data collection would greatly aid law enforcement in apprehension and prosecution efforts.
