I'll also put the text below for anyone who struggles with word documents. You can also add details of your own experience (or lack of) if you can to make it more personal. The more of them get this, the bigger the pressure, and the more likely it'll be brought up in the House of Commons.
Dear (MPs NAME),
I am one of your constituents, and a member of a 1022 member strong support group for family members caring for a person with Schizophrenia/Psychosis.
I want to make you aware of a Piece of UK Law, Section 117 of the Mental Health Act (AKA Section 117 Aftercare), that is purposely being ignored by both NHS trusts and Councils across the entirety of the UK, and putting lives at risk. We know that hundreds, if not thousands of people in the UK have died as a result of suicide, or homicide, that could have been prevented had Section 117 been implemented by the NHS and Local Authorities according to law.
The decision is being made to ignore this law that exists to protect both people with serious mental illness, and the wider public, in order to save money. The attitude seems to be "Pounds before people". It looks to us that it doesn't matter how many people die, as long as money is saved.
The British Medical Journal estimates that there are around 120 people murdered in the UK by people with mental illness annually.
Recently, there was the high profile case of Valdo Colcane, who killed 3 people in Nottingham. Having been detained under section 3 of the mental health act, several times, he was automatically eligible for section 117 aftercare under section 117 of the mental health act. He did not get it. This is law, it is being flouted, and this needs to be exposed. Both the NHS, and local councils are actively making the decision to withhold support that these vulnerable people are legally entitled to, and so they have blood on their hands. There needs to be accountability.
Recently there were also the Killings of the young girls in Southport. We don't know the mental state or history of the perpetrator at this stage, but I don't think any of us would be surprised if he was also suffering from a serious mental illness, and was known to mental health services. I anticipate that these details will come out in time.
Section 117 of the Mental Health Act 1983, also known as "section 117 aftercare", requires health and social services to provide free support to people who have been detained under certain sections of the act. Having been part of a discussion among the majority of members about this, it is obvious to us that failure by NHS trusts, and Local Authorities to do their legal duty, is not only commonplace, it is the norm. Our loved ones, and others, who do not have supportive families, are being discharged having been sectioned under the mental health act for the safety of themselves or others, with little to no support despite the existence of Section 117 of the MHA .
I wonder how many lives could have been saved had this law been followed? It's already law, but it's being ignored, our loved ones who are already vulnerable are suffering and being left without support once they are discharged from hospital, and the huge responsibility is left solely to us. People are dying because of this blatant negligence. How many more headlines do there need to be before this is taken seriously? Things need to be put right, and there needs to be accountability. We want change, but we need your help. Ignoring this and allowing it to continue means that you too are complicit in any further negligence or bloodshed as a result of this scandal. Section 117 is already law, but it needs to be enforced.
We want:
Mandatory training for psychiatrists, psychiatric nurses, and social workers across the whole of the UK on their legal obligations under section 117 of the mental health act.
2. A mandatory, formal way for recording if and when patients have had an assessment for S117 aftercare. This could be a form that the patient or nearest relative signs and is given a copy of, detailing the support that they will receive, that is uploaded to the NHS System and recorded. The care quality commission can view these in their inspections, and failure to provide and record S117 aftercare will impact their CQC ratings, and information stating this will then be made publicly available in their reports.
3. Legal consequences which could include large fines, compensation for neglected patients and their families, or other victims, and a simple way for patients/carers/solicitors to challenge Section 117 not being adhered to, in court.
The law is already there! But it is being disregarded and there are no consequences. Enforcing section 117 of the mental health act would mean better care for people with serious mental health problems, reduced hospital admissions, and lower suicide, homicide, and violence rates by providing them with the care in the community that they are already legally entitled to. This is another national NHS scandal! It's happening every day and there need to be consequences. Failure to enforce this law will mean that there will continue to be avoidable hospitalizations and deaths, and the government, as well as the NHS and local Authorities will have blood on their hands.
We have contacted a number of high profile investigative journalists to expose this scandal. Now we want your help to stop it. Enforce Section 117 of the Mental Health Act and make the public bodies who are failing us, our loved ones, and the wider British Public accountable for their gross negligence.
