End the use of business names in court cases
The Issue
I've been a victim of identity theft, name theft, and a malicious invasion upon my names and real estate titles. In three cases within the New York State Supreme Court, County of Kings, I have faced unfair legal practices, particularly in case 508692/2017. This case, initiated by a business entity, started as Gemcap Funding LLC, listing multiple business names as plaintiffs, yet no identifiable human is cited as the complainant. This has deprived me and many others of due process under both federal and state laws.
The usage of business names, along with terms like "John Doe" or "Jane Doe," as either plaintiffs or defendants in court proceedings, is a significant issue that demands attention. These practices obscure transparency and accountability, allowing for exploitation and circumvention of legal standards. Without knowing the actual person behind a business or a pseudonym in a legal case, justice cannot be fairly administered. Courts are left dealing with faceless entities rather than real individuals who are accountable for their actions.
Allowing business names to operate anonymously presents opportunities for fraudulent actions against unsuspecting individuals, further complicating and prolonging legal disputes. This abuse ultimately undermines the very purpose of our legal system, which is to uphold justice.
In cases like mine, the representation of businesses without individual accountability has resulted in significant personal and financial harm. We must put an end to this practice to restore fairness and clarity to our courts.
This petition urges all courts in the United States to require the presence of actual, identifiable human parties in all legal proceedings. The plaintiff must be a real person with a vested interest in the case at hand, while the defendant must also be a person, not a faceless corporation or an anonymous pseudonym.
By signing this petition, you're supporting a move towards greater transparency and fairness in our judicial system. We must protect individuals from identity theft and other crimes exacerbated by current legal loopholes. This change is crucial for ensuring just and equitable outcomes for everyone involved in legal disputes across the country.
I call on you to lend your support to this cause by signing this petition. Together, we can push for a legal environment where individuals are protected, and justice is served transparently and fairly.
