End Selective Prosecution (Equal Protection Equals Equal Punishment)

The Issue

The current infrastructure of Government permits employees and officials to overlook, brush aside or otherwise impose sanctions (such as desk duty, suspension, reassignment or acceptance of resignations) for crimes committed by their entities' staff.  And the discretionary power that allows them to decide, without regulation, what, if any, crimes they will pursue into the prosecution stage is called selective prosecution.

   Our Organization aims to lobby for the criminalization of the act of selective prosecution. Similar to the Good Samaritan law, the Selective Prosecution statute would prohibit when "a person is found to have knowingly or willingly disregarded a crime committed by a member of Government without taking action for arrest or warrant for arrest " Inside or outside of work duties, there must be accountability and the constructive knowledge of those who are aware must be brought forth to justice.  This will be satisfied when the due diligence standard is the applied threshold. Without duly diligent action by Government members who are aware of crime, another crime is the result - Selective Prosecution.

   Some say that mandating prosecution upon Government officials raises the subjectivity level to above and beyond all of society.  However, presently, they are above and beyond the law whenever their associates or coworkers choose not to prosecute, and the lawlessness rests in the hands of discretionary power. So society has called for the only proper remedy to this matter, holding Government officials to a higher standard where every law must be obeyed and strictly enforced. 

   Restoring confidence in Government agencies and strengthening the infrastructure for the future can only occur if law reform that enforces accountability is enacted. Also proposed is a reform to the law on corruption to delete the exception inclusion of "influenced in the performance of any official act" and substitute "which may present conflict of interest, ethical violations or undue influence to perform acts or favors in, or outside of, official capacity ".
