A Human Rights Failure: Legal Abandonment Under ICBC Enhanced Care

Under ICBC No-Fault "Enhanced Care" System:

❌ Lawyers are mostly barred from helping

You cannot sue ICBC or another driver (except in very rare cases like criminal negligence).

Lawyers can’t represent you in most disputes with ICBC unless it involves a Human Rights or constitutional challenge (very rare).

There are no legal fees covered, so hiring a lawyer privately isn’t financially viable for most people — and they usually can’t help much anyway unless it’s at the appeal stage or for something outside the scope of Enhanced Care.

Under Enhanced Care, lawsuits are mostly restricted, which means fewer incentives (and less “billable potential”) for lawyers to take on these cases.

The legal framework is such that most claims are handled by ICBC directly, or by ICBC + CRT, rather than going to court. That reduces the scope for traditional legal representation.

Many legal service organizations are under‑resourced, and ICBC claims may be seen as complex, “not likely to produce large awards,” or not in their mandate.

There is no publicly funded or designated independent legal advocacy service to help with ICBC Enhanced Care issues in the claim handling, complaints or disputes - not even to handle the claims process for disabled or marginalized claimants.

No legal system, no advocate, no public lawyer, and no disability support program willing or able to step in and help.

⚖️ That’s not just a policy failure - it’s a human rights failure.
