End ICBC No-Fault Framework: The Erosion of the Rule of Law - Detrimental Harms to Victims
The Issue
[Updated: End ICBC No-Fault Insurance System Protect the Victim - Not the Insurer]
ICBC’s No-Fault "Enhanced Care" system claims to aid the victim. In reality it's a corporate cost cutting machine.
Instead of supporting injured British Columbians, it repeatedly harms them.
The ICBC framework and BC No-Fault system stripped British Columbians of their legal rights, access to contingency counsel, and independant legal oversight over the claims and care process. This leaves vulnerable injured citizens to be exploited by bad-faith actors who are omitting critical data, are misattributing and actively minimizing, contaminating electronic medical records gatekeeping time sensitive specialized properly protocolled MRI imaging required to identify occult trauma being overlooked by systemic medical misallocation. Consequently, patients are forced into unsafe, active treatments before their injuries are cleared by an independent specialist and not being provided the injury supports they require and being prematurley "diagnosed" on false painted narratives.
By barring access to independent medical experts free from insurer control and banning the right to sue for true-life losses—even when a victim sustains severe life-altering injuries or a loved one is killed—this framework actively compromises patient safety and guarantees worsening medical outcomes and where severe injuries without the proper MRI imaging from the start and independent medical care can be fatal, and stripped away their legal right to sue for their true life loses- even when a victim sustains severe life-altering injury or a loved one is killed.
Over the past 13 years, the state has steadily eroded British Columbians' constitutional access to justice, independent legal support, and fundamental rights, causing profound real-life harms.
Giving all the power to ICBC and it's framework overreach into and affecting our medical system and stripping disabled, vulnerable injured victims of motor vehicle collitions and the families of those who have lost loved ones of their Constitutional Rights and Protections and of their Bodily Autonomy.
Victims of legislative changes: Bill 22, Bill 11, the Limitation Act, and the loss of access to a contingency lawyer.
2013 the State stripping the statute of limitations for Civil Claims and CRT from 6 years to only 2 years and Human Rights to only 1 year.
2019 Injury caps and transitioning from rightful due process under the Court of Law to the CRT for "minor injury cases" (A Detrimental System for those with disabilities, who sustained occult life-altering injuries, and who don't have the financial ability to hire a lawyer by the hour.)
2021 implementation of BC's pure No-Fault system.
The Reality of the No-Fault System:
Even under the No-Fault system's strict 'Section 116 exceptions—which claim to allow lawsuits against drivers convicted of criminal offenses like drunk driving—There are significant structural imbalances inherent in the system that disadvantage victims sustaining life-altering injuries and lost loved ones due to negligent drivers.
Because the No-Fault system framework bans suing actual financial losses like future income and medical care, specialized trial lawyers still cannot afford to take on motor vehicle injury cases. Furthermore, since ICBC is insulated from paying out court-awarded tort settlements, an injured victim can only collect compensation directly from the personal assets of the driver.
Unless the negligent driver happens to be independently wealthy, the innocent victim is left entirely empty-handed. The state has created a system where justice is reserved only for those who have money to afford to pay a lawyer by the hour (if they can even manage to find a lawyer still taking motor vehicle injury case) and injured by a wealthy negligent driver
The Eradication of Civil Rights Through Police Inaction - Procedural Failures and the Loss of Civil Recourse Under BC Auto Insurance Law
In standard tort law, a victim only needs to prove fault on a 'balance of probabilities' (more likely than not). However, the current BC system requires a criminal conviction, meaning the state must prove the driver's guilt 'beyond a reasonable doubt'. If a police officer fails to charge the driver with a criminal offence, fails to investigate, gather evidence, or check if a driver is impaired for objective evidence—even where a victim should have received a rightful Section 116 exception—the officer failing their due diligence entirely strips the victim of their civil right to sue the driver. This remains true regardless of the severity of the driver's actions, the victim's life-altering injuries, or if the negligent driver killed a loved one.
Under this broken no-fault regime, reckless and negligent drivers face no accountability, and victims are stripped of their fundamental right to sue. Pain, suffering, and long-term losses are dismissed as collateral damage, dehumanizing those who need help the most.
- Sustaining severe life-altering injury or a loved one killed by an At-Fault driver, being told no one is to blame.
- Being denied fair compensation for lifelong injuries, trauma, disability, lost earnings and life loses.
- Receiving a fixed, bureaucratic payout that ignores your actual true life losses and pain and suffering.
The Loss of Future Earning Capacity is Ignored
In a traditional tort lawsuit, a lawyer could argue that even though you hadn’t made money yet, you were actively building a business, possessed marketable skills, and lost the future capacity to earn that income. Under ICBC’s no-fault rules:
Income replacement is calculated strictly as 90% of your demonstrated net income.
If your tax returns or corporate accounts show $0 or a net loss for the previous year because you were in the startup phase, your income replacement benefit is set at $0.
The system does not compensate for true life loses, destroyed career trajectories, or the time you invested into building a business that you can no longer run.
"Pain and Suffering" is Replaced by a Rigid Metric
In the old system, you could sue for "pain and suffering" based on how much the injury ruined your quality of life (e.g., being unable to enjoy hobbies, severe daily pain, mental health struggles).
Now, you cannot sue for pain and suffering. Instead, ICBC offers a Permanent Impairment Benefit.
This is a lump-sum payout, but it is strictly tied to a medical matrix (a percentage rating of your physical or cognitive function).
If you have a severe, invisible or occult undiagnosed injury, like spinal cord or nerve root compromise, continuous nerve involvement that is the direct cause of multiple sustained mechanical functional impairments, developed chronic pain or a mild brain injury that completely halts your ability to build your future but doesn't hit the strict medical definition of a "catastrophic impairment" (like paraplegia or severe amputation), your lump-sum payout will be remarkably low—and in some cases, non-existent.
While your actual life losses and career potential are uncompensated, under the no-fault system you are still entitled to:
Medical and Rehabilitation Expenses: Direct payment for physiotherapy, counseling, occupational therapy, and medications.
Personal Care Assistance: If your injuries mean you cannot do your own house cleaning, grocery shopping, or basic daily hygiene, ICBC will pay for a care aide or cleaner (up to $11,872 monthly for severe needs).
Recreational Benefit: If you have a documented permanent impairment, you can get up to $4,000 every two years to help you adapt or participate in leisure activities you can no longer do normally
The Criminal Exception and ICBC Insurance Shield
Under the narrow Section 116 criminal exception, even if the police actually do their due diligence, lay a charge, and secure a criminal conviction against the at-fault driver, you can only sue that individual driver personally.
ICBC walks away: Under Enhanced Care, ICBC completely removes itself as the payout mechanism for lawsuits. They do not pay out a tort settlement or third-party liability coverage for pain and suffering like they did in the old system.
The "Judgment-Proof" Reality: If the criminal driver is poor, has no assets, no house, and no savings, they are what lawyers call "judgment-proof." You can technically win a million-dollar lawsuit against them in civil court, but you will collect $0 because you cannot squeeze blood from a stone.
The Illusion of "Equal Benefits"
The province marketed the no-fault model under the premise that everyone gets "care and recovery benefits, no matter who is responsible". But what this actually means in practice is that the system creates an artificial equality that punishes vulnerable victims:
- The negligent, reckless, or impaired driver gets their medical treatments paid for by ICBC.
- You, the innocent victim whose business and life were destroyed, get the exact same rigid medical grid.
The Erasure of True Life Losses Under No-Fault
-
Because ICBC forbids you from suing for your actual life losses—like a freelance artist, photographer, or entertainer's destroyed startup potential; a gig worker's seasonally fluctuating income; a student who hasn't entered the workforce yet; or a retiree whose spare-time enjoyment was gardening, tinkering with vehicle projects, going boating, exploring, traveling or just relaxing—ICBC successfully avoids ever having to pay a comprehensive financial settlement for a victim's true life losses. Instead, they are only required to pay for basic survival mechanics, such as physiotherapy and basic care aides, while the victim's fundamental life enjoyments are entirely stripped away.
The Ultimate Catch - Systemic Unfairness of the No-Fault Framework
In the old system, if an assetless or poor driver hit you, you could sue them, and ICBC’s third-party liability insurance would step in to pay you the settlement on that driver's behalf (up to the policy limit, which was usually $1 million to $5 million).
Now, by banning lawsuits and introducing Enhanced Care, ICBC has legally insulated itself from ever having to pay out those large third-party liability settlements to victims. If the person who hit you has no money, the law ensures you are trapped entirely within ICBC's bureaucratic, low-payout medical framework, with zero avenue for true financial restitution.
By design the current system weaponizonizes the legal definitions of "minor injuries," ICBC routinely minimizes long-term claims to cut off medical benefits and escape paying permanent impairment lump sums.
Coercive Gatekeeping and the Exploitation of Unrepresented Victims stuck under ICBC's largely bias vendor system that appears to all prioritize minimizing and aiding ICBC's bottom line over proper patient-centered care to protect their billing relationship.
- ICBC-contracted medical vendors are utilizing incorrect initial intake documentation—specifically deploying the Standard Medical Report (CL489). Inputting severe, red-flag neurological symptoms onto standard CL489 forms. By using the standard form—which is structurally reserved exclusively for claimants with zero functional impairment or work absence—the vendor forces a life-altering injury into a minor, soft-tissue administrative category. instead of the mandatory Extended Medical Report (CL489A)
- Medical Records not reflecting true clinical presentation and lived life experience and omitting objective evidence that supports and seriously injured citizen's injury claim
-
Misrepresenting the medical-legal boundaries of the document. When patients explicitly report severe structural clinical presentations, vendors manipulate injured laypersons by claiming they "cannot document what hasn't been pre-diagnosed" or that noting and using words such as, 'spinal' and 'nerve' constitutes "patient self-diagnosis."
- Systemic Medical Modality Misallocation: Patients with life-altering occult injuries with red-flag nerve involvement, such as spinal cord (myelopathy) and nerve root (radiculopahy) compromise, are being sent for all the wrong tests (x-rays, CT scans, EMGs) when their clinical presentation warrants specialized MRI imaging.
- Systermic Privacy Violations: Public and Private entites are withholding critical injury data documentation from injrued victims required for fair claims managaement, not making factual amendments or annotation of the record to ensure false and misleading are being relied upon, running out a vicitim's limited 2-year statutes.
- OIPC System Failing Injured Vicitims Privacy Figths: The OIPC cannot force amendments to something the vendor didn't document. Long waits in OIPC queue for review while active Priavcy vilations are occuring and OIPC inacction, minimizing core complaints splitting into subcatagories and counting towards 2-file max when are steps in a core complaint and disregarding illigal violations of withholding of critical records (such as communications with ICBC, attendance and billing logs) skipping past access and instead pushing for "correction" when needing data being withheld under an injured vicitm's name for fair and transparrent injury file management of public and private entities.
- Vitims being forced to battle ICBC's bad-faith conduct first hand causing mental distress with no legal support or protection.
- Having medical needs questioned or rejected by ICBC’s own hired doctors and no access to a second opinion.
Systemic Destruction of Medical Evidence, Data Contamination, and the 2-year Limitation Act Trap
A core mechanism of the No-Fault framework is the systematic manipulation and withholding of objective medical-legal records by both public and private entities, engineering an artificial claim profile that drastically misrepresents the true severity of a victim's physical state.
Failure of Patient-Centered and Bad-Faith Actors Contamination of Electronic Evidence - Administrative Data Alteration and Medical-Legal Fraud - Both official Electronic Medical Records (EMRs) and ICBC Report Documentation Sent though the Direct-billing Vendor Portal and Fax - Gross Failure in Patient Safety and Clinical Care.
- Hiding / Deleting vicitims' true clinical presentation and supporting evidence from their electronic chart, such as: tended to by Emegency Services: First Responders, BCEHS and Triaged, Being Stretchered, Spinal Protocoled, The Use of Spinal Board, Mechnaical hoist for Imaging, Nursing Interventions, Medical Misalocation Already Done and needing the proper protocoled MRI imaging needed, and hiding the Trauma Protocoled Objective MRI Imaging that provides susatined injury information.
- Misusing Forms: The basic CL489 over the proper CL489A, fraudulent Abulatory over Triage, and section 28.1 to force premature diagnosis and minimize claim outcome.
- Omitting proper pre-accident baseline data, misrepresenting post-accident clinical presentation.
- Omitting Objective MVI date: Which paints a false narrative of 'crumbling skull'.
- Injecting fraudulent Motor Vehicle Incident (MVI) dates and Fabriacted Imaging timelines into the electronic files to override a victims true objective MVI date.
- Easure Nerve invovement in Length of Spine and Key Injury Sites and Bi-lateral Trauma Clinical Presentation with localized nerve involement in all limbs: Omitting spinal and only documeting as one sided, which strips away the true clinincal presentation of central spinal cord compression (myelopathy) and localized nerve root damage (radiculopathy).
- Modality Misallocation: ICBC direct billing vendors are sending patients with occult trauma injuries with red-flag clinical presentation to the wrong kind of Dr, being given unessary, and at times even repeat, modality misallocation of only X-rays, CT and EMG testing when requiring specialized properly protocoled MRI imaging.
- Data contaminating high-resolution MRI imaging with inaccurate and incomplete data requisition to the raidiologist, and fabricated other Imaging "compared to" and compairing post MVI imaging with other post MVI imaging, incomplete data, and data poisoning—rendering them legally invalid. Crucial clinical data and baseline has been deliberately corrupted or erased.
-
The Fabrication of Continuous Care Through "Ghost" Intakes: Unknown to the injured vicitim ICBC contracted vendors are misusing public specialized pathways—such as Rapid Access Clinics (RAC) and G.F. Strong Rehabilitation Centre—by conducting a single, superficial visit with no proper investigation of the sustained trauma injuries, and then keeping the file open as a fraudulent, year-long intake creating a false electronic paper trail that makes it appear as though the victim who sustained life-altering injuries and still requires proper MRI imaging to determine the extent of those injuries and for potential suregical intervention, is receiving ongoing, specialized rehab and injections. In reality, the victim has been completely discarded and left with an inaccurate write up and misatributing their sustained trauma injuries without MRI imaging, and no access to an independant second opion free of ICBC's framework. ICBC is able to weaponize a false painted "active" intake to block funding for the urgent independent MRI diagnostics, claiming the public system is already managing the case.
- Direct Billing Admintrator Alternation: intercepting and overriding a licensed medical professional's (like physiotherapist's and massage therapist's) Stripping away reported red-falg clinical presentation, and objective clinical findings and medical supports and aid recommendations in Initial Intakes and Treatment Extension Reports, by deleting clinical terms like "nerve," "numbness," and "spine," . Which allows the digital billing portal to auto-approve cheap, basic care while permanently erasing the patient's clinical truth and the medical evidence required to trigger specialized care, MRI diagnostics needed and higher-tier funding.
The Systemic Withholding of Records: Medical vendors and ICBC systematically withhold critcal records. specialist reports that document life-altering injuries and severe functional impairments and with Inaccurate reporting that needs correction that's being actively ultizized by bad-faith actors to minimize a claim outcome. Systemic disregard / refusing to amend factual inaccuracies or annotate contested data.
- The system has created an administrative excuse that allows ICBC to abruptly cut off or entirely withhold vital home care assistance, necessary physical treatments, and temporary wage-loss support, destabilizing the victim's daily life.
Weaponization of the 2013 Limitation Act Loop: By ICBC and direct billing vendors controlling record creation and sharing, delaying record releases, and suppressing the objective evidence of a seriously injured vicitim needed for fair claim management, the system forces an unrepresented victim past their strict statutory timelines and runs out their 'legal clock', compounted by the removal of contingency lawyers - has removed victims' access to Justice.
The Farce of the Civil Resolution Tribunal (CRT) and the Systematic Denial of Due Process: Victims are being falsely misled into appealing to the online CRT believing they have access to a fair appeal process. In reality, the CRT is an online portal that completely lacks independent judicial oversight. The tribunal issues permanent, binding decisions based strictly on the rigged, withheld, and contaminated data presented to them by ICBC.
Because the system has weaponized the removal of legal representation, low-income and struggling individuals are left with no independent legal counsel to challenge these deep factual inaccuracies in a proper court of law. By stripping away the fundamental right to due process, this framework completely insulates institutional bad-faith conduct from accountability.
This leaves victims with nowhere to turn: the 2019 systemic removal of access to contingency lawyers, compounded by the 2021 legislative removal of bodily autonomy and independent care, has systematically stripped away British Columbians' legal right to a fair hearing, objective adjudication, and meaningful justice.
What was advertised as "Enhanced Care", in reality is a cost-control strategy and a system allowing Enhanced Exploitation
A system built to protect ICBC’s financial bottom line.
The system allows ICBC, incentivised direct billing vendors and bias providers, lack of patient centered care, medical avoidance, systemic FIPA and PIPA violations, serious Administrative Unfairness that the OIPC and BC Ombudsman as BC's "watchdogs" are failing citizens and also don't hold the powers as the rightful court of law.
The No-Fault system stripping away their access to legal support and recourse limiting lawsuits, and reducing ICBC's claim costs, all at the expense of the victims.
In a proper court of law, citizens don't worry about upfront costs; contingency lawyers provide legal support, alongside the right to compel independent evidence and cross-examine.
This framework is not care—it is a gross conflict of interest that strips victims of their constitutional rights, bodily autonomy, and legal protection.
Proving the current system stripped away the accountability of negligent drivers causing bodily harm and death, and of public and private bad-faith actors, and all injured victims regardless of injury appearance and financial status, especially those who sustain life-altering occult injuries (such as but not limited to: incomplete spinal cord, nerve compression, spinal injuries - disc herniations, brain injuries), especially if sustained from a 'stiff-pulse' crash mechanism of injury trailer hitch receiver rear-end collisions (where the vehicle doesn't look that damaged), seriously injured victims with no independent patient-centered care provider free of the insurer's overreach to oversee their trauma injury care and electronic medical records / MEDITECH, and those who have lost their lives and families who have lost loved ones, without video footage of the crash, loss of or no witnesses, need access to contingency lawyers and wherever there is the opportunities for bad-faith actors to take advantage of a system that has removed access to independent legal oversight over the claim and care process, the only place is under the proper Court of Law and due process.
These issues have been widely underreported and poorly disclosed to the public. The time for real change is now.
The Weaponization of the Removal of Legal Oversight Over the Claims and Care Process
Under this system, ICBC’s biased medical vendors operate with zero independent legal oversight to deter bad-faith behaviour. By eliminating the threat of legal accountability, the state has insulated the insurer from liability and stripped away checks and balances.
The Illusion of Oversight: The Funded Mandate of the ICBC Fairness Officer
Manufactures the appearance of accountability, a "Fairness Officer" is maintained using the mandatory premium dollars extracted from British Columbia drivers. In reality, this office is financially dependent on the very corporation it is tasked to oversee, and under the Insurance Corporation Act, it is structurally denied the independence and legal power required to hold ICBC meaningfully accountable
Under the Insurance Corporation Act, the Fairness Officer:
- Cannot reverse decisions on fault or payments
- Has no authority to award compensation
- Cannot hold ICBC accountable for unjust decisions.
- Cannot make corrections to factual inaccuracies or critical omitted data in a victims claim records, and does not chase down the truth. The CRT makes binding decisions on what's presented before them.
There is no direct public record showing the exact dollar figure that the Fairness Officer deposits into his bank account each year. Additionally, ICBC is required to reimburse the officer for any necessary operational expenses, which includes the cost of hiring supporting staff to help manage and process complaints. Paid directly from British Columbians' Insurance Priumiums.
Excluded from the "Sunshine List": British Columbia publishes an annual Financial Information Act (FIA) report (often called the "Sunshine List") detailing the exact salaries of all public servants and Crown Corporation employees earning over $75,000. However, it's informed because the Fairness Officer is structured as an independent vendor/contractor billing via invoices, the names and precise personal take-home pay do not appear as a standard line item on that employee list.
Injured and Alone: The Cruel Reality of ICBC’s Enhanced Care
There is no independent advocacy for individuals navigating ICBC’s Enhanced Care system. Seriously Injured people are left to deal with ICBC alone while struggling with injuries, and laypersons needing legal advocacy, and unable to afford a lawyer by the hour.
Those with cognitive impairments and seriously injured victims without a trusted independent care provider to oversee their electronic medical records are at a worse disadvantage being left with ICBC who was given all the control and without legal representative to protect them.
ICBC’s internal complaint system is tiered and an emotionally burdensome dead end, creating further harms and struggles to already injured struggling victims.
These barriers are rooted in ICBC policy - systemic administrative unfairness the State has built into the claims process to serve the corporation, not support the individual.
Unsecured Digital Systems and the Vulnerability of Electronic Medical Records
This system allows any vendor with access to an injured victim's claim number or their electronic records to unauthorized generate reports and poison their records with inaccurate, misleading and omit critical information. Affecting their access to the proper timely truma protocoled imaging, proper specialist care (such as: neurosurgeone and neuro-otho spine.), and the home supports, medical aids, and funding they need.
As the Trial Lawyers Association of BC stated, “You have no lawyer, no advocate, and no real right of appeal. It’s David versus Goliath - if David had a concussion and no slingshot.” When someone is injured, broke, and traumatized, telling them to “just represent yourself” is not access to justice it’s cruelty by design.
The State Must Protect Claimants’ Rights & Well-Being
Return ALL motor vehcile injury victims back to the rightful due process under the Court of Law.
- Reinstate pain and suffering compensation for all from at fault drivers, all passengers, hit-and-run victims, Injuries from Poor Road Conditions or Government Negligence and Mechanical Failures or Product Defects.
- Restore the ability to sue at-fault drivers for fair compensation for freelance, self-employed and gig workers who face disproportionate hardship.
End ICBC control over injured vicitims records, their treatment providers and victim's right to bodily autonomy.
- Remove ICBC’s restrictions on clinical reporting, including arbitrary word counts and limited templates.
- Ban insurer interference in Doctors and Specialists recommendations and treatment decisions in patients' care and care provider collaboration.
ICBC’s system of direct billing and contracted treatment providers creates systemic pressures that can compromise impartial care, as providers may feel obligated to prioritize cost control over patient needs. While there are providers that act ethically, the lack of transparency and independent oversight makes it difficult to ensure all injured individuals receive fair and unbiased treatment.
The system disproportionately impacts those without financial means, who are forced into ICBC’s restrictive care network, while individuals with resources can often seek independent care outside this system. We demand transparent oversight, independent evaluation of treatment providers, and equitable access to unbiased, patient-centered care for all, regardless of income or status.
- Abolish Independent Medical Examiners (IMEs), now known under the No-Fault system as Comprehensive Medical Assessments (CMAs)
The use of ICBC-employed or contracted Independent Examiners and Assessments has raised serious concerns regarding impartiality, potentially leaving claimants with limited access to fully independent assessments and without independent legal support and advocacy.
Patients should not be subjected to evaluations by providers whose financial interests are tied to the insurance company. Instead, all medical assessments related to claims should be conducted by healthcare providers with no financial relationship to or being paid by to ICBC or any insurer. This ensures unbiased, fair, and accurate evaluations, which are in the best interest of the injured party.
Restoring Bodily Autonomy, Tort Rights, Legal Protection, Security of Electronic Medical Records, Objective MRI Imaging and Internal File Records, and Accountability of Harms to British Columbia's citizens.
Injured British Columbians must have the unequivocal legal right to sue both negligent drivers and ICBC when their actions cause harm, disrupt lives, or impose mental distress, coercion, and negligence.
- Stop misclassifying serious long-term and complex conditions as "minor Injuries."
- Update care and fund specialized condition-specific treatments and evidence-based therapies.
ICBC’s system routinely misclassifies many serious long-term and complex conditions - including spinal cord and nerve root compromise, nerve damage, disc bulges and herniations, soft tissue trauma, neurological complications and chronic pain affecting daily living as “minor injuries.”
This harmful misclassification:
- Restricts care access, even for life-altering or long-term conditions.
- Minimizes real pain and suffering, especially in invisible or delayed-onset conditions.
- Limits support, compensation, and recovery options.
- Ignores medical complexity, forcing a one-size-fits-all approach and ignoring individual needs.
- Undermines Lived experiences
- Devalues legitimate pain and suffering.
- Restricts specialized and properly protocoled MRI imaging and proper specicalized care access leading to delays in healing, worsened long-term disability outcomes.
- Compromizes safety and can be life-threatening.
- Left hidden and unmanaged by being gatekept from the proper specialists, serious occult sustaines injuries have catastrophic physical decline that can, result in preventable worsened outcomes and even death.
We need an immediate end to the inappropriate use of the “minor injury”. Assessments must be individualized, trauma-informed, and built on clinical judgment that acknowledges occult / invisible injuries, centers the lived experience of the injured person, recognizes that red-flag clinical presentation present from the moment of impact are real and must not be overlooked or misattributed, and takes delayed-onset injuries seriously. All Injured citizens deserve access to fair independant true patient centered medical care they need with legal oversight. - without delay or denial.
Restore Public Transparency & Accountability
- Require ICBC's full clear public disclosure of limits on no-sue legal recourse limitations in all public communications.
- Publish annual Enhanced Care financial and claimant-impact reports (including savings vs unmet needs)
- Acknowledge and publish the public rights lost under the current no-fault system.
- Conduct meaningful public consultation before any future insurance model reforms.
- Focus enforcement on unsafe and careless drivers causing motor vehicle accident, not shifting the financial burden and hardships on injured accident victims.
We call for opening the insurance market to allow independent, third-party insurers to compete with ICBC, ending the monopoly and giving British Columbians more choice, better service, and fairer claims handling. Opening the market alone isn’t enough
You want competition, but also a return to full tort rights (i.e., the right to sue and fair compensation for injuries). Opening the market isn’t enough on its own. British Columbians deserve not just competition, but the restoration of full tort rights. True reform means restoring the right to sue, reinstating compensation for pain and suffering, and ensuring all insurers - public or private - must uphold fair compensation, access to justice, and medical decisions based on care, not cost.
British Columbians were promised better care - but what we got was voided legal protection, ICBC taking advantage and control, limited access to treatment, and a silencing of vulnerable voices. Help us demand fairness, dignity, and transparency from our Governement and Public Insurer.
Premier David Eby and the BC NDP introduced ICBC’s "Enhanced Care" model - a system that has caused real and lasting harm to injured British Columbians and their families. - David Eby continues to defend it despite widespread public outcry. Under his leadership, injured people have lost:
British Columbians deserve a Premier who puts people before profits, patients before corporations, and justice before bureaucracy.
The People of BC Need Help!
While ICBC is a provincial agency, the ongoing harm caused by the ICBC Framework and its "Enhanced Care" system is affecting the lives of countless Canadians living in British Columbia and those with visit our province. This harm stems from decisions made by British Columbia's NDP provincial politicians lead by David Eby who implemented and continue to defend a model that strips injured people of basic rights, access to care, and legal protections.
British Columbians have lost trust in their current provincial leadership. Many feel abandoned, voiceless, and trapped in a system that puts cost savings ahead of compassion and accountability.
We respectfully urge the BC Human Rights Commissioner our Governement 'Watchdogs' the BC Ombudsperson and the Office of the Privacy Commissioner, and the Government of Canada to Acknowledge and support change for injured British Columbians and their loved ones.
We ask for your awareness, concern, and support:
- Acknowledge that injured British Columbians and their loved ones are being exploited to save ICBC money.
- Recognize that ICBC’s removal of their right to sue for proper life losses has dehumanized injured people and is seriously affecting their mental health, recovery, and fundamental human rights to fair compensation and proper treatment.
- Injured British Columbians mental health and pain and suffering are being exacerbated by the intense stress in the absence of legal advocates to support and defend them - resulting in significant long-lasting harm to their overall well-being and their fundamental human rights.
- Recognize that the Constitutional rights and well-being of injured Canadians in B.C. are being neglected.
- Acknowledge that the lack of access to contingency lawyers. legal recourse and oversight over the claima and care process under the current ICBC model raises broader questions of fairness, justice, and human rights violations.
- Stand with Victims of this System and ensure the changes that need to happen to protect all Citizens.
We urge all elected officials and oversight bodies to take immediate action to restore fairness and accountability.

The Dispute: The clinic attempted to charge an applicant a rate of $125 per 15 minutes, totaling $375 for 45 minutes of clerical work to compile and provide access to the patient's medical charts.
OIPC Confirmed under the Personal Information Protection Act (PIPA) that private clinics cannot leverage excessive, unreasonable fee hurdles to obstruct a patient's access to their own medical data.

A complainant requested access to their personal treatment records (following a motor vehicle accident) under British Columbia's Personal Information Protection Act (PIPA). Allied Coast Therapy charged a $300 fee to process the request.
[12] The word “may” in s. 32(2) of PIPA means an organization’s decision to charge a fee is discretionary. Therefore, an organization’s decision not to charge a fee under s. 32(2) of PIPA has the same effect as a fee waiver because the access applicant is not required to pay the organization a fee for obtaining access to their personal information.

The Complainant also alleged the Organization and ICBC breached the Complainant’s privacy and that the Organization’s employees or healthcare providers acted inappropriately. The Complainant also detailed their problems and concerns with ICBC’s handling of their motor vehicle injury claim.
On September 22, 2026, David Eby travelled to Government House in Victoria, BC to meet with the Lieutenant-Governor to request the official dissolution of the Legislative Assembly, triggering the snap provincial election.
The broader 2026 all-party Special Committee of MLAs was the structural execution of that legal commitment to evaluate whether the care-based model was truly meeting the ongoing needs of crash victims. The election call abruptly dissolved the legislative special committee reviewing the legally mandated ICBC five-year-old "Enhanced Care" No-Fault insurance model was just underway, before noon, on only the second day of hearings.
The sudden dissolution of the committee left exactly 144 individual written submissions (out of 175 total submissions, which included 30 from medical and stakeholder associations) and numerous planned oral presentations from victims, advocates, and health providers in limbo.

Widespread ICBC Direct-Billing Portal Vulnerabilities (Documented 2025): Province-wide complaints showing that ICBC’s standardized direct-billing contract terms force healthcare providers to grant broad, unmonitored computer system access for "Performance Management," critically compromising practitioner-patient confidentiality, HIPA/FIPPA boundaries, and data integrity.
Concerns raised over new ICBC rules for health-care providers.

Relevant OIPC - Withholding of Patients' Own Clinic Record Injury Data and Information in Relation to Motor Vehicle Incodent with High Fees
OIPC Order P25-08 (Northshore Medical Hub November 19, 2025): https://oipc.bc.ca/documents/orders/3055
The OIPC ordered the clinic to slash the fee down to a reasonable baseline of $73.23 and issued a binding order forcing the clinic to refund the remaining balance of $301.77 to the patient.
Order P26-08 (Allied Coast Therapy May 22, 2026): https://www.oipc.bc.ca/documents/orders/3165?Lang=zho
Additional matters in the Complainant’s submissions
[16] The Complainant’s submissions include matters that fall outside the issues identified in the OIPC’s notice of inquiry provided to the parties. For example, the Complainant made arguments about the accuracy of their clinical records and the failure of the Organization to correct their personal information in those records.
