The Issue

After reading Dr. Robert Malone's insightful opinion piece in the Brownstone Institute recently, it became clear to me that the expansions of PREP Act liability protections represent a significant overreach during the Covid-19 pandemic. These expansions could potentially violate the Loper-Bright decision, which limits agency overreach under the Chevron decision, a cornerstone in our legal system for ensuring administrative accountability.

Under the Biden administration, these protections were broadened beyond their original scope. Initially focused solely on safeguarding health organizations in relation to Covid-19 vaccines and therapeutics, the protections now extend unwarrantedly to childhood vaccines, seasonal flu vaccines, and even to non-qualified healthcare workers. This shift not only blurs the lines of accountability but also potentially undermines the trust of the public in our healthcare system.

The PREP Act was designed to facilitate quick responses to public health emergencies by shielding healthcare entities from certain legal liabilities, thereby encouraging the rapid development and distribution of necessary medical countermeasures. However, expanding this shield indiscriminately across broader healthcare sectors has far-reaching implications. It dilutes the accountability expected from manufacturers and distributors of non-Covid related vaccines and dilutes the integrity of healthcare delivery.

We are at a critical juncture where it is vital to reassess these expanded protections. Encouraging Robert F. Kennedy Jr., the Secretary of Health and Human Services, to use his authority under the PREP Act to rollback these extensions is necessary to focus accountability where it is most warranted. These changes should be revisited to ensure that liability protections are applied appropriately and only to Covid-19 vaccines and related therapeutics, as initially intended.

By scaling back these extensions, we can restore much-needed transparency and responsibility in the healthcare sector. This is not only essential for maintaining public trust but also for upholding the democratic principles against governmental overreach.

I urge you to join me in calling for this decisive action. Let's protect the integrity of our healthcare system and ensure that the PREP Act serves its rightful purpose. Please sign this petition to encourage HHS Secretary Robert F. Kennedy Jr. to promptly revise these liability protections.
