More than 63 million Americans are subject to private government imposed by condominium and homeowners associations run by volunteers who are untrained and frequently further their own personal agendas to the detriment of other co-owners and the community itself. Co-owners have no recourse beyond expensive lawsuits in which they face overwhelming odds against them due to nonprofit corporation law and the business judgment rule.

Regulation that provides an even playing field and an opportunity for American citizens to challenge unfair imposition of rules and fines by private governments outside of the legal system is long overdue.
