The Issue

Pennsylvania’s Constitution requires a “thorough and efficient” system of public education. The current system is neither.

How so?

  • More than half of Pennsylvania's children are not proficient in reading.
  • Almost two-thirds are not proficient in math.
  • Taxpayers spend about $24,000 per pupil.
  • Typical non-elite private tuition is about half that.
  • Failed schools do not close. School property tax still comes due.

On September 21, 2026, Kenneth and Roberta Krawchuk of Abington filed a Petition for Review in the Commonwealth Court of Pennsylvania (Krawchuk v. Shapiro, Ward, and McClinton, docket number 441 M.D. 2026) asking the Court to:

  • Declare the present public school system in violation of Article III, Section 14 of the Constitution;
  • Phase out the local school districts and their operating monopolies;
  • Direct existing state and federal aid into an Education Savings Account of $11,500 per child (first year), usable at any private, religious, Montessori, or technical school, even for homeschooling;
  • Create a citizen-run standards and testing board;
  •  Make school property tax unnecessary once a school district's operations end — with no new tax in its place!

We support that filing. Redirect the money to the child. Fund education, not the monopoly. End the school property tax millage when the districts wind down.

Signing this page is public support only. It does not make you a party to the lawsuit, a co-petitioner, or a client. Becoming a petitioner takes a separate signed verification and a filing with the Court.

Why this petition is important: The courts have already held the existing school funding system unconstitutional. Years later, test scores are still a coin flip on reading and worse on math, and the property tax millage is still on the bill. This case asks the Court to stop paying the monopoly and start paying the student.

If you are a Pennsylvania taxpayer or parent and want the Court to add you as a petitioner, that is a separate legal step. Use this page only to show support. To petition the Court to be a party on the suit, see http://KenKrawchuk.com/4F/Contact.html for details.
