Election Violation at Uptown Marina Lofts Condominium Association

The Issue

We, the undersigned unit owners of the Uptown Marina Lofts Condominium Association, hereby bring to your attention our collective grievance concerning the recent Board of Directors' election conducted on November 9, 2023.

It has come to our notice that there was a failure to adhere to the Florida Statute governing condominium elections, specifically the requirement to send out the first notice of election at least 60 days prior to the election day (Florida Statute 718.112(2)(d)1.a). This lapse has denied us the opportunity to participate fully in the association's governance, a right that is fundamental to the integrity and fairness of our community's operational structure.

Due to this oversight, many unit owners were not adequately informed about the election in a timely manner, thereby impeding our ability to either present ourselves as candidates or to make informed decisions regarding the selection of our representatives on the Board of Directors.

We respectfully request that an investigation be undertaken to provide the unit owners with a detailed explanation of the reasons behind this oversight and the initiation of corrective measures, including the consideration of conducting a new election with proper adherence to the statutory notification requirements. 

We believe that these steps are crucial for maintaining transparency, fairness, and trust within our community.
