The Issue

Georgia’s school district and Georgia’s lawmakers “failed to protect” this “Mandatory Reporter” when she spoke out on corruption that ended in RICO charges for educators who cheated students out of their rights to be educated; all for bonus money! See how the school district and judicial systems destroyed her life after she was labeled a “Whistleblower” The Superintendents’ bonus for her tenure was a whopping $587,000! *Lower court Judge just allowed RICO felon  to walk, after [refusal] by Appeals and Ga Supreme Courts! A major INJUSTICE for students!

SPEAK NOT HEAL NOT; “A Culture of Silence Driven by Fear of Retaliation;” A Metaphor for Much That’s Needed to be Said! By law,  “Mandatory Reporters” are not Whistleblowers!!

Where there is silence, there is NO justice. Where there is no justice, there is NO healing. Where there is no healing, there are NO dreams. Where there are no dreams, there are NO children. Where there are no children, there is NO vision. Where there is no vision, there is NO hope. Where there is no hope (for justice) THERE’S NO HOPE FOR PEACE!!

Educator Abby Zwerner of Virginia, under law 22VAC 40-705-40, was shot by a student with special needs after other
educators and administrators including the Superintendent, (KEPT SILENT); and failed to make a report of known dangers that lingered among the entire student body. According to Zwerners' attorney, "Three times school administrators were warned by concerned employees and educators that the boy had a gun, but the administrators could not be bothered!" It was teacher Zwerner herself that made the first report that the boy had threatened to beat up another boy. There had been knowledge of this child possessing a gun throughout the day of the shooting, but no one took the courage nor initiative to follow through on the (ABOVE) “Mandatory Reporter” law. The Superintendent has since been voted out! Teacher Abby Zwerner's attorney is accusing administrators of failing to stop the violence after multiple warnings,"THE ROAD TO FULL RECOVERY WILL BE LONG," the attorney added!

Please ask yourself this; (WHY DO EDUCATORS REFUSE) to speak up when they are mandated by law to do so when working with children? Then go to this next scenario in Georgia and see the existence of a LACK of [consensus] of that same law!

Educator Naomi Williams, under Georgia “Mandatory Reporter” law O.C.G.A.19-7-5(a); of Atlanta Public Schools did quite the opposite! (SHE DID SPEAK UP) in support of the districts' 47,000 students that led to RICO indictments and jail time for educators, administrators and the Superintendent as well. For standing up and speaking out, I was harassed, humiliated and retaliated against. Documents were falsified against me, I was denied a transfer out and subjected to mental and psychological traumas. After being wrongfully terminated and taken away from students that much needed my classroom skills and motivation, I became homeless; having to seal my car from the elements as it became [our] makeshift home. I had to resort to cleaning jobs, a very short stint at warehouse work, along with gathering food from branches and trees. Then I was hit with mental and psychological battles; it felt as though my life had come to an end!

These educators were cheating students out of their true and rightful education by inflating their test scores to meet district targets and earn bonus money; at the same time setting these students up for failure in life! This action had gone on for a whole decade! The ramifications were great; ruining lives and shattering dreams and livelihoods as students grew older. Many educators took part in the scheme while some refused and made attempts to reveal to their superiors the dilemma they faced. As a result, “A Culture of Silence Driven by Fear of Retaliation,” lingered. This kept teachers quiet as they got to witness first hand the harm against whistleblowers. Those who joined in the injustice against students were recognized with praise,  while those who refused and spoke out suffered retaliations including documents falsified against them like; excessive absenteeism, overrated tardies, falsehood of physical abuse against students and of course insubordination, were all levied against them. There were 178 educators implicated, 80 resigned or retired in an effort to avoid termination and prosecution and 35 were indicted. Some educators took plea deals and turned state witnesses while twelve took a chance and went to trial! Thirty eight principals at the APS school district took accountability for their actions, all except one; Dana Evans! She was found guilty of RICO as well as one additional charge. Georgia Bureau of Investigation reported that Superintendent Beverly Hall orchestrated the event and "either knew or should have known about the cheating;” the same charge levied against principal Evans! There were 256,779 answers that were changed from wrong to right!

After being asked by her lead teacher Dessa Curb to erase a student's wrong answers and replace them with the right answers, educator Naomi Williams refused. She stated that to do so would compromise her integrity as well as portray a false sense of academic achievement that did not exist and set students up for failure. Williams sought out to REPORT this to the principal as spelled out in the “Mandatory Reporter” Law. Educator Curb confessed to the cheating, but principal Evans did nothing to her but fired Williams instead! Educator Curb confessed to GBI investigators that in the event students marked two answers she would erase the wrong one or even marked the answers right when students left behind blank spaces where they made no attempt to answer. Williams instead opted to follow the “Mandatory Reporter” law for Georgia, and proceeded to report the incident to the district and to the Professional Standards Commission. The Code of Ethics and Whistleblowing at Atlanta Public Schools stated; “If a potential ethical violation arises, notify your immediate supervisor, the Office of Internal Compliance or the ethics officer in the Law Department, you will not suffer any punishment if you make a report in good faith.”

Additionally, Superintendent Hall stated to educators; “If you know about lying and cheating, and you are afraid (of blowing the whistle), I really have to question your character. You are covering up (for) the liars and cheaters…When you cover it up, you are as much liable as the person who is doing it, in my humble opinion…How can I even have some sympathy for people who have no COURAGE when children are being hurt, and the system is being hurt!” (2010).

Even more egregious than educators cheating students out of their education; The Atlanta Public Schools district and The Georgia judicial system imposed and falsified documents against employee Whistleblower Naomi Williams. She and others who came forward as witnesses suffered harassment, humiliation and retaliation before being "wrongfully terminated.” Educator Williams, after SPEAKING UP, was fired! She became jobless, homeless twice with her child in tow and very sick even BEFORE being terminated. She fell prey to “severe” depression, anxiety, insomnia, pain and other forms of PTSD as she suffered horrendous mental and psychological backlashes and even nervous breakdowns.

Even Georgia courts dealt hard blows of injustice against her and other whistleblowers who sought protection and restitution for their losses. Lawmakers have failed to protect her as two indicted felons were allowed to walk free!

Ms. Williams fought hard to clear her personnel records, but to no avail. “NAOMI WILLIAMS’ PREDICAMENT HAS CAUGHT THE ATTENTION OF LAWMAKERS HERE AT THE STATE CAPITAL, WHO BELIEVE THAT PUBLIC EMPLOYEES ARE STILL NOT AFFORDED SUFFICIENT JOB PROTECTION [AFTER] THEY BLOW THE WHISTLE!” Channel 2 Action News.

Advocate attorney Joe Bird regarding whistleblower Williams stated, “Naomi suffered through the worst of the scandal in Atlanta. As a lawyer, I tried to help her, but the system suffocated her voice and her information until the dam broke. She is a quiet hero if not a victim deserving of our help!" Whistlewatch.org stated; “ATLANTA  SCHOOL SYSTEM HARMED CHILDREN AND THE WHISTLEBLOWER!” “The public should be outraged that Ms. Williams continues to suffer whistleblower retaliation when this woman put her duty as a government employee and commitment to children before her own personal gain…Parents and other whistleblower teachers should step forward to support the courage she has shown to help children, the tax payer and the public at large.” When attempting to file suit against the district, the judge in Ms. Williams case, Judge T. Jackson Bedford stated to Ms. Williams, "You will never win this case,” then proceeded to allow her attorney to withdraw, despite her motion otherwise. This left Ms. Williams to fend for herself since no other attorney was willing to pick her up with having no money as well as being in the (middle) of a RICO case; now she faced [unequal and unfair representation]. This judges’ preconceived opinion represented nothing more than prejudicing my case; therefore I motioned for his recusal, Williams stated.  He agreed to step down, but in a spiteful move; the judge replacing him, Judge Kelly Lee Ellerbee, would “nail my coffin shut,” claims Williams! Her very first statement to me; “Ms. Williams, I see you don’t have an attorney,” then began her charade of laying down punishments against me for not having one. She refused to allow me to state or present any documents in  justification to charges levied against me. She refused anything favorable to those documents I carried that would vindicate me. She immediately dismissed my case [with] prejudice, then mooted it, as if to say that there were no other matters to [ever] be discussed in this case! However, at the time of my hearing, the GBI investigation, the grand jury nor the trial itself had finished or laid down its 800 page summary, where evidence would be favorable on my behalf. Neither had the trial itself begun, Williams stated. The GBI investigation and trial fell under Judge Kelly Lee Ellerbees’ rulings; shutting me out of any chances of vindication or justice. The Professional Standards Commission stated there were no infractions against me or my license. The Georgia Department of Labor, after a thorough investigation, declared that, “Ms. Williams broke no rules or laws causing her to be terminated!” I was constantly denied a hardship transfer; the stress and anxiety behind this led to my mental breakdown. My doctor had removed me from the job on three occasions, and principal Evans, in writing, [recognized] my illness prior to termination but continued to press me to quit. I refused because I had done nothing more than followed the “Mandatory Reporter” law; I had done nothing wrong and plus, it was during the height of the “recession!” The stress subjected against me came when the districts’ refusal to transfer me out of Dobbs Elementary as I tried to protect my already passed 4 out of 5 tests needed to get me out of Dobbs elementary and into a certification program. All those years, hard work, sacrifices and money went down the drain with my wrongful termination, causing extreme PTSD. Williams states that her mental stability is supported by medications costing nearly $10,000 a month!  “Without sponsors and support taking care of me,  i would have no reason to live!!” Just as in educator Zwerner’s case, Williams stated, “THE ROAD TO FULL RECOVERY HAS BEEN AND WILL CONTINUE TO BE LONG-STANDING FOR ME AS WELL!”

Another egregious act performed by a Judge Jerry Baxter, on a personal note, [gifted] felony principal Evans a reprisal to her jail sentence; all because she was once counselor to his son while in school! Evans walked, even though a three-judge appeals panel upheld her RICO conviction! Likewise, the Georgia Supreme Court even refused to overturn her sentence. Per Chief Judge Christopher McFadden, “Evans allowed cheating on standardized tests to take place at Dobbs. She prevented others from discussing it, threatened teachers and retaliated against at least one other person for speaking to GBI.” Judge Jerry Baxters’ actions, in essence, helped in the destruction of Whistleblower Naomi Williams’ life and further added to the injustice already committed against these innocent students. Allowing this tried and convicted felon to just “walk,” defeated the whole purpose of the trial and finally bringing an end to students being left behind; this judge used his own foot to crush down the students and the whistleblowers! After the trial, Williams, who did the RIGHT THING, and her son attempted to speak with the judge, but he would not allow it! However, he had several communications with principal Evans, whose actions against the students were unjustified, and she is now a FELON!

According to Prosecutor Clint Rucker - “I think that she (Naomi Williams) is entitled under the law to be rehabilitated with what defense counsel has referred to on several occasions as “The best evidence, which is the tape of the incident itself which you can hear Ms. Curb on the tape in the background yelling at the children and disrupting Ms. Williams’ teaching session!”

Sadly, in the documentary that spelled out the story of the scandal; “ONE CHILD LEFT BEHIND,” indicted educators CONFESSED, that [YES], they did inflate students test scores, but only in an effort to keep the schools from being closed!

Whistleblowers in schools, [PROTECTED UNDER LAW], continue to be retaliated against; posing direct dangers to students in attendance. Whistleblower Naomi Williams’ son was retaliated against as well. He was pulled out of line of his baccalaureate rehearsal ceremony. And to this day Atlanta Public Schools continues to hold his high school diploma hostage!

During the longest running and most costly trial in Georgia’s history, it was Superintendent Halls‘ staff to confess that “Whistleblowers were retaliated against!” Superintendent Maria Carstarphan stated, [“Whistleblowers should NOT be punished!!] Whistleblower Naomi Williams life was destroyed; left in shambles for speaking truth of the injustice against the students. Williams stated, “The Mandatory Reporter” law places those making reports in a “DOUBLE BIND;” either stand by and watch innocent children continue to be harmed or SPEAK UP and you yourself become victimized! Williams is seeking restitution from the APS school district, as well as the Georgia Judicial system. She’s asking the courts to reverse its ruling and grant her lawsuit so that she can start a true “HEALING” of all the despair waged against her for such a long time because of her following the law and for doing the “right thing” by speaking up for the students!

Educator Naomi Williams is seeking JUDICIAL ACCOUNTABILITY - “If the law can render judgement against those who break it, then that same law should show accountability to those it victimized in the process!” Williams stated, “We need Truth, Accountability, Legislation, Reform and Change!” Terminated  for “doing the right thing,” Atlanta Public Schools whistleblower Naomi Williams says she regrets speaking out on the cheating scandal!

THE TEACHER BRAND
“This sort of thing happens all the time but gets swept under the rug. Administrators at the school and district are given unchecked leeway when it comes to actions against teachers and staff, whether supported or not. Principals can put things in an employees file that is incontestable, except in a written rebuttal, though that doesn’t carry the same weight as the original. Districts have a clear policy where they side with the principal in all matters, unless it involves an egregious offense against a child. That is why Ms. Williams and others in this case were terminated despite her status as a whistleblower. Even in the event of a victorious court case against the school district, the emotional, mental, and financial impact of the ordeal can have a lasting impact.”
