Good Morning Fellow Residents, Commuters and Petition Supporters

Please keep sharing the Online Petition www.tinyurl.com/MoreParkingNow so we can hit the 10,000 mark. We are getting closer with the number of Supporters being just under 7900 at present.

In this Update I will cover the following

1)      Edmondson Park Residents Objections to Frasers Development – Independent Planning Commission

2)      Bryon Road – Resurfacing by Camden Council

3)      LCC Email to CEO – Reply received

1)      The Independent Planning Commission has uploaded Objections onto its website. I lodged 4 and only 3 have been displayed, I am checking into the 4th Objection which was a PDF Document and was emailed in.

2)      Signs have been erected to advise that Bryon Road is about to be resurfaced. This could mean that Commutors parking in Bryon Road may not be able to. I have sent an email to Camden Council asking for further details BUT they don’t usually reply to my emails as I am not a Camden Resident.

Can you please advise IF that correspondence has been sent and IF replies have been received?

Is it possible to obtain copies of Correspondence Sent and Received??

Is it Possible to Obtain Information on the number of letters sent to the Premier, Minister for Transport, Department for Transport regarding the Car Parking Crisis at Edmondson Park and Leppington during 2016, 2017, 2018 and 2019 and the number of replies received?

Based on recent Local Newspaper Articles and TV reports it would appear that we are not much closer to have additional car Parking Spaces provided Ed Park and Leppington Stations than we were years ago.

Also from the article In the past 12 months, 84 motorists were slapped with fines for parking illegally at the station, with a total of 240 fines issued since January 1, 2017, according to Transport for NSW.

Could you advise IF fines issued by Liverpool Council Rangers were included in the Figures quoted. IF NOT could advise the number of fines issued by Council Rangers during the same Period?

Also, Any additional information you can provide regarding the timing of
the promised Car Parking Spaces by the State Government would be
most welcomed and will be emailed to the now 7700 plus #MoreParkingNow Car Parking Crisis Petition Supporters.

Dear Mr Andjelkovic

 

I refer to your email of 7 October 2019 in which you requested:

 

1.       In response to the NOM (see below) was a letter sent to the Minister.

2.       Was a response to that letter received?

3.       Number of letters sent to the Premier, Minister for Transport, Department for Transport regarding the Car Parking Crisis at Edmondson Park and Leppington during 2016, 2017, 2018 and 2019

4.       The number of replies received?

5.       a total of 240 fines issued since January 1, 2017, according to Transport for NSW.

a.       Were fines issued by Liverpool Council Rangers were included in the Figures quoted.

b.       IF NOT could advise the number of fines issued by Council Rangers during the same Period?

 

Access to information held by Council is governed by the Government Information (Public Access) Act 2009 (GIPA Act).

In accordance with the Act your request was treated as an informal request to access information.

I am authorised by the principal officer, for the purposes of section 8 of the GIPA Act, to decide your informal access to information request.

 

In dealing with your informal request I considered:

 

·         The information you sought and whether an overriding public interest may prevent release or whether it contained someone else’s personal information.

·         Whether the imposition of reasonable conditions would assist the release of the information.

·         The resources and time that would be required to search for and retrieve the information.

·         How the information could be supplied to you and whether it could be presented in a form that would provide you with access without affecting the interests of others.

Decision

Following my consideration of your request I have decided that access to most of the information you sought can be provided informally,

however the letter received by Council from Gabrielle Upton MP, Parliamentary Secretary to the Premier dated 3 September 2019 could not be provided. 

The reason that a copy of this letter could not be provided is that a third party consultation is required to release any information that is not drafted by Council.

I can advise that the letter acknowledged Council’s letter of 15 August 2019 and advised that the Minister for Transport was the appropriate member to provide a response to the letter.

The following information is provided response to your request.

1.       A letter was sent to the Minister on 15 August 2019 (copy attached)

2.       Letters sent to The Hon. Gladys Berejiklian MP, Premier and The Hon. Andrew Constance MP, Minister for Transport and Roads on 15 August 2019 (copy attached).

5.       Since January 2017 Council issued 201 parking fines in Bernera Rd (previously Croatia Ave) & Soldiers Pde. Council Officers are not authorised to issue fines on SRA land (carpark) this area is enforced by the Police and Transit Officers.

 

As indicated, additional searching is required to ascertain the correspondence to and from Council between 2016 & 2019 (questions 3 & 4)

 QUESTION WITH NOTICE By Councillor Nathan Hagarty

Background - Despite allocating just $212,000 in this year's budget, the New South Wales Government continues to commit to a 'mid 2020' time frame for the completion of a multi-storey car park at Edmondson Park station. Potential risks to the project's completion date have been given as "weather, Liverpool Council and other land holders".

Please address the following:

1. Does Council own land within the vicinity of Edmondson Park train station suitable for a multi-storey car park?

Council does not own any land suitable for the construction of a multi-storey car park close to Edmondson Park railway station.

2.Has Council been approached by the State Government about the use of Council owned land for a multi-storey car park at Edmondson Park? If so when?

As indicated above, Council does not own any land in the immediate vicinity of Edmondson Park station and hence Council has not been approached for a carpark to be constructed on Council’s land. However, Transport for NSW (TfNSW) have approached Council to discuss the agencies’ environmental planning, preliminary design investigation and arrangement to lease or acquire land for construction of the additional commuter parking spaces close to Edmondson Park station.

Council is advised that negotiations to lease land from adjoining land owners is underway and Council will be notified of the timing once suitable site/s have been identified and design investigations have commenced. In addition, TfNSW also enquired whether Council would be able to project manage the construction of at-grade car parking once suitable construction site/s been secured. Requested indicative costs have been provided to TfNSW.

3.What approvals would Liverpool Council need to give for a multi-storey car park at Edmondson Park?

Construction of a multi-storey car close to the Edmondson Park station can be approved under the following two assessment regimes:

a)TfNSW can lodge a Development Application with Council for assessment under Part 4 of the Environmental Planning and Assessment Act;or

 b)TfNSW can lodge an application for environment assessment under Part 5 of the Environmental Planning and Assessment Act to the Minister for Planning, which provides for Infrastructure Development by Public Authorities. If TfNSW lodges a Development Assessment with Council, depending on the development site, the application would be assessed under State Environmental Planning Policy (State significant Precincts) 2005.

A commuter car park close to the station, would be defined as a “passenger transport facility”. A commuter car park is permitted with consent, within the B4 zone. The DA would likely need to be determined by the Sydney Western City Planning Panel as it will involve crown development over $5 million and would be deemed regionally significant. If the cost exceeds $30 million, the DA would be deemed State significant and would be assessed by the Department of Planning Industry and Environment. 4.Are there any other delays or impediments Council could potentially cause to the timely completion of this project?

No. However if a Development Application is lodged with Council,the application will be assessed and likely reported to the Sydney Western City Planning Panel for determination.

As this decision relates to an informal request for information it cannot be reviewed.

 

Other options

 The GIPA Act provides other options for you to consider that may enable you to access the information you sought. You can make a formal request to access the information.
