Here is my speech I prepared for the planning commission meeting and I have emailed it to 4 commissioners.

1. 2 years ago, the expansion permit for republic services that city of San Jose granted was based on the EIR study period from 2005 to 2009, and there were no violations, but right after the study period, in 2010-2011, the Newby Island Garbage Dump had 6 gas emission violations! Therefore, we can say that the EIR report no longer reflects the truth, so, we ask commissioners to no vote on the expansion.
2. The EIR report says there were few resident complaints about the garbage dump, but reality is the odor exists for very long time. Odor victims just didn't know how and where to complain. Since Residents got informed on how, from Dec 2014 to January 2015, there are around 500 odor complaints and the BAAQMD issued 2 public nuisance tickets to the landfill owner. In the meantime, we have over 10k online and over 1k paper signatures opposing the expansion. This data has proved the base of the EIR and the granted permit are spoiled. Please abandon the expansion permit.
3. Please to be aware that if the landfill owner can't manage the odor and gas emission on 150 ft dumps, how can you trust them to manage 245ft and 58.5 million cubic yards? The wind can help the 150 ft dump to reach everywhere in Milpitas, parts of Fremont, N San Jose, and Santa Clara, how do you determine the odor of the dump with 245ft won't reach farther and reach your home or office? So, for you and your family, for millions of residents and employees in odor impacted areas, please vote no to the expansion.
4. Mitigating the dump odor is too expensive for landfill owner to practice on daily base, so many dumps in the past have chosen to close or transfer trash to remote areas. Bay Area has more than a dozen dumps that have been closed. Deodorizing the odor has never been a landfill owners' choice. If republic services promised to mitigate the odor, it will be for the purpose of getting permit only. According to my study, a landfill in Livermore is less than 35 miles away. Please let Newby Island the dump transfers the trash away and don't grant the expansion permit.
