It has been reported in various social media platforms that certain individuals have been offering services and charging clients, in somecases upto $25K - $40K by giving them hopes of building their profiles to fit the EB1A category

THIS IS A CALL FOR INQUIRY INTO ACTIVITIES AND BUSINESS MODELS BUILT AROUND EB1A. THIS IS NOT INTENDED TO DEFAME ANY INDIVIDUALS OR BUSINESSES 

We are requesting USCIS and DHS to thoroughly inquire the activities and services provided by these individuals (listed in the petition below) and also re-assess the evidence submitted by applicants who used these services because it is likely that the evidence would have been built using paid, artificial methods

We, the undersigned, come together as concerned individuals who deeply value the fairness and legality of the United States immigration system. With this petition, we aim to shed light on a pressing issue that has been affecting the EB1A immigration category and its aspiring beneficiaries. We implore the Department of Homeland Security and USCIS to take action against the proliferation of "unauthorized" immigration advice provided by individuals who are "not qualified immigration attorneys", but are capitalizing on the hopes and dreams of vulnerable immigrants.

It has come to our attention that certain individuals, often originating from the tech industry, have ventured into the realm of immigration consultancy services, specifically targeting the EB1A category. While these individuals may possess expertise in their respective fields, they lack the necessary legal training and qualifications to provide immigration advice. They often present themselves as consultants who can offer assistance in navigating the complex process of obtaining a green card through the EB1A category.

This country has many qualified "Immigration attorneys" who are actual attorneys and can provide such legal advice to immigrants. Therefore, these individuals who have turned this into a money making part time business need to be prosecuted and prevented from doing such business

Just because someone went through the process does not make them qualified to talk and advise about immigration and that too for money

This is tantamount to someone without a medical degree opening a business to make money by advising patients of medication just because they went through the same illness and know what medication to use. Such practices should not be encouraged

These unqualified consultants charge substantial amounts of money for their services, preying on the hopes of aspiring immigrants who are eager to secure permanent residency through the EB1A category. Their actions are not only ethically questionable but also have serious consequences for the immigration system as a whole.

Consequences:

Increased Backlog: The surge in individuals seeking the services of these unauthorized consultants has led to a surge in EB1A applications, subsequently exacerbating the already-existing backlog within the immigration system. This backlog harms those individuals who are genuinely eligible for EB1 visas and seek to contribute positively to the United States.


Misguided Applicants: Vulnerable immigrants are lured by the enticing promises made by these consultants, who often manipulate the intricacies of the EB1A category to give a false sense of security. As a result, applicants may invest significant resources and time pursuing avenues that may not yield successful outcomes.


Legal and Financial Risks: By offering immigration advice without the necessary legal credentials, these consultants put both themselves and their clients at risk. Such advice could lead to legal complications, rejections, and even deportation.


Our Appeal:

We, the signatories of this petition, urge your intervention to curb the detrimental impact of unauthorized immigration consultancy in the EB1 category. We respectfully request:

Enforcement of Legal Standards: Vigorous enforcement of existing laws and regulations to prevent unqualified individuals from offering immigration advice.


Increased Awareness: Initiate campaigns to educate vulnerable immigrants about the dangers of seeking advice from unlicensed consultants and encourage them to seek guidance from "licensed immigration attorneys".

Fast-Tracking Genuine Cases: In order to alleviate the EB1 backlog, expedite the processing of applications that meet the legitimate criteria for the EB1 category.

Our collective concern is rooted in a deep desire to uphold the integrity of the United States immigration system. By addressing the unauthorized immigration consultancy issue within the EB1 category, we can ensure that the dreams and aspirations of deserving immigrants are not exploited, and that the system remains just, fair, and transparent.
