Drop charges against autistic teen tased after seatbelt stop

The Issue

On July 8, 2016, Tawnya Nevarez, her two minor children, and her three year old niece were on a 5-10 minute trip when the family was pulled over by a Burbank Police Officer for a minor seatbelt infraction. Ms. Nevarez's son is a 16 year old with special needs including autism, ADHD and mental health challenges. The officer was immediately aggressive to the disabled minor teen. Ms Navarez informed the officer that her son was autistic several times. Despite several requests by Ms. Nevarez to call for back up and to allow her to deescalate the situation, the officer continued in a hostile, aggressive and threatening manner toward the disabled minor son specifically and the family in general. A simple traffic stop ended with the officer threatening the teen and pepper spraying him and his sister. The officer also tased the autistic teen resulting in him having a seizure as he laid on the ground. The teen was taken to the hospital and arrested. The Nevarez family is in shock and has been devastated by this incident. Ms. Nevarez was told no charges would be filed against her son. After issuing a press release that completely contradicts the mom's eyewitness account, the police department has now filed 3 misdemeanor and one felony charge against the autistic teen. The charges are an attempt to deflect from the officer's improper handling of the minor traffic stop. We are seriously troubled by the incident and what may be use of excessive force and violation of the civil rights of both teens. Autism impacts 1 in 68 children and many children with autism have sensory and cognitive deficits. There is no evidence that the autistic teen committed any crimes and he shouldn't face criminal charges. He has already been traumatized enough!
