The Department of Law Has Spoken With the Press

Do not be discouraged! We expected the State to retry Clayton, as often happens in wrongful conviction cases, so their announcement to the press that they intend to do so is no surprise to us. 

As the family of Jocelynn Allison, we are the only victims in this case. In most states, the district attorney is representing the interests of victims when filing charges and prosecuting cases. Yet, the Department of Law has not spoken to any of the victims (us) in the case about our wishes or their decision, and do not seem to intend to.

That is the very reason this petition was formed. The State can still change their mind at any time and drop the charges - even mid-trial. They need to hear the outcry from the public together with the voices of Jocelynn's family asking them to stop. You are partnering with us to strengthen our voice.

For those of you learning about the case for the first time, you can review the Court of Appeals opinion reversing the conviction based on a single appeal item (the ban of Ehlers-Danlos Syndrome evidence at trial). Our appeal included multiple issues that could have been grounds for reversing the conviction - not just that one. 

Unfortunately, it was prohibited from including specific categories of injustice that occurred -- like the extensive prosecutor lies to judge and jury, which you can read about in Mrs. Allison's official letter to the court. The letter explains in exacting detail the numerous times that prosecutors told the judge and jury that family members were making up incidents during trial of Jocelynn hitting her head on other occasions, when in fact these events were told to police on the very day Jocelynn died and in multiple interviews in the following weeks.

The letter also explains that Jocelynn's mother was being repeatedly accused by prosecutors during and after trial of not providing information to police "questions" during an interrogation where she was being tortured, as a 22-year-old bereaved mother, with autopsy photos of Jocelynn cut up into pieces as they attempted to force her into agreeing with them that her husband was at fault. She will have to live with the memory of that interrogation and the photos that the same prosecutor said he would "never want another human being to see" for the rest of her life.
