This center is little more than a whitewash for the Rudin Condo plan. The planned North Shore-LIJ center is detrimental to the health of our neighborhood and our city. The existing Certificate of Need - for a full service hospital at the site - should be enforced.

WE THE UNDERSIGNED call upon Commissioner Nirav R. Shaw, M.D., M.P.H. to deny the application for a North Shore-LIJ’s Certificate of Need (Project # 111531) for a planned “Comprehensive Care Center” at the O’Toole building at 36 Seventh Avenue, New York, New York, for the reasons made clear in the numerous submissions and testimony to Manhattan’s Community Board 2, The New York City and State Departments of Health, the Attorney General of New York State, The New York City Planning Commission and other governmental and non-governmental entities. Recent studies including the Berger Commission and the 2008 St. Vincent’s Needs Assessment in their Strategic Plan have all determined that St. Vincent’s Hospital provided “essential” health services to New York State. We call upon the commissioner to uphold and enforce the existing Certificate of Need for a full service, Trauma I hospital at the site of the former St. Vincent’s Hospital.
North Shore-LIJ’s application violates New York State law section 28 of the Public Health Law, in that it ignores the existing, recognized Certificate of Need for a full service hospital at the site, and section 510 and 511 of the New York State Not for Profit Corporation Law, in that this plan will convert public assets without reasonable or fair consideration and that it does not further the charitable mission. We also believe that this sale does not comply with the provisions of 501(c)3 of the Internal Revenue Code in that this sale and the proposed Rudin plan does not continue the charitable mission of St. Vincent’s as it is required to, namely a full service hospital.
It is our belief that this facility will prove both detrimental to the health of New Yorkers and costly to New York taxpayers. The closure of the full service, trauma I hospital at St. Vincent’s has put significant strain on the emergency departments at Bellevue Hospital, New York Downtown Hospital and St. Lukes/Roosevelt Hospital. Replacing these vital services with an ambulatory clinic will result in transfer of patients to North Shore-LIJ’s expensive hospital beds at Lenox Hill Hospital, the eviction of primary care physicians from and underserved area and inferior patient outcomes.
The North Shore-LIJ plan is illegal, expensive to the taxpayer, and most importantly bad for the health of New Yorkers. We call upon you to deny this application pending the inclusion of a full service hospital and compliance with all relevant state and other applicable laws.
