First the good news: Ontario’s Consumer Protection Act was badly out of date, and the Ontario Government finally decided to update it via Bill 142.

Now the bad news: Despite the urging of consumers, consumer advocates, consumer organizations - including Canadians for Properly Built Homes – and opposition parties, the Ford Government refused to include newly built homes in that critical update to Ontario’s Consumer Protection Act. That included refusal to include Tarion in the updated consumer protection legislation.

Given the scope restrictions related to Bill 142, CPBH decided to focus on builders SECRETLY selling newly built homes with used and damaged furnaces*. But, this too was once again rejected by the Ford Government in Bill 142, even though a legal opinion says that this SECRET practice contravenes the old Consumer Protection Act. While Minister McCarthy tried to sell his new consumer protection legislation in Bill 142 as “comprehensive”, sadly it was not.

It's important to remember that before the 2018 election when the PCs came into power, the PCs promised to end Tarion's monopoly. But now they haven't.

 

*Tarion and the Tarion spin-off, HCRA, have refused to take any action related to this.
