

Some progress - Tarion has announced increasing its maximum payout to $400,000 for "new freehold homes".
In Feb/21: Standing Committee on Public Accounts recommended: “Tarion Warranty Corporation increase the maximum limit of $300,000 paid to homeowners when builders do not honor their warranty, to better reflect the costs of home construction in Ontario”.
But at this point it's still only an announcement from Tarion - these changes will not take place until July 1, 2023 and "will help homeowners who enter into a purchase agreement on, or after, that date". Why this continued delay? Why continue stalling? CPBH has heard from homeowners who needed this increase years ago. Tarion's financials suggest that Tarion should be able to afford to pay these claims.
Tarion previously disclosed that they had received some claims that exceeded the $300K limit. Some of our unanswered questions for Tarion that remain:
- How many claims have exceeded the $300K cap?
- By how much did each of them exceed the $300K limit?
- Will Tarion consider these homeowners for a “customer service gesture” from Tarion to cover the legitimate claims in excess of $300K?
Given the importance of this issue, CPBH previously wrote to the Tarion Board Chair, Mr. Hari Panday. But these questions remain outstanding. CPBH recently reminded Tarion that we are still requesting answers to these questions.
