Many are anxiously awaiting Justice Cunningham's Tarion Review recommendations (expected in Dec. 2016). This 70% rejection rate for 2013 is one key indicator that Justice Cunningham needs to recommend major changes related to Ontario's new home warranty. Clearly, tinkering around the edges won't fix this 70% rejection rate or Tarion executive sky-high salaries. So, what are key major changes that Justice Cunningham could recommend? - separate the regulator and warranty provider roles - make new home warranty optional for Ontario's purchasers - focus on ensuring that the home is properly built at the outset (i.e., no Code violations) rather than dispute resolution - end Tarion's monopoly and give Ontarians a choice (like 89% of the jurisdictions in Justice Cunningham's own "jurisdicational scan" included in his Interim Report). Ontarians are counting on you, Justice Cunningham!
