Don't let my father's killer walk free.

In 1986, my father, a restaurant owner in Manhattan was shot and killed by Justo Santos who immediately fled the country to avoid being punished. Justo Santos admitted he walked into my mom’s and dad's business along with two others and that he murdered my father with the gun that he was illegally carrying. Recently, on Thursday, October 30, 2014, he walked free after a year and four months in jail - waiting for what we hoped would be a trial. I need your help to get an appeal for the case. Please ask Manhattan District Attorney Cyrus Vance and his colleagues to revisit the case within the 30 days they have to make this decision.

I was just a child when my dad, Jose Martinez, was shot to death in front of his restaurant in 1986. I remember how hard he worked to provide for our family and protect us from violence in the streets. The restaurant was a place of joy and family gatherings and Justo Santos changed all of this when he walked into the restaurant with two friends, to harass and intimidate the waitress and eventually kill my father.  He turned our beloved business into a crime site – a place my mom and dad had worked so hard to build.

You can imagine our horror when we found out that my dad’s life had been taken. And, you can probably also imagine our outrage and confusion when Justo Santos admitted to killing him but was protected by international laws which would not allow authorities to bring him to the United States to face charges.

Confusing international laws kept Justo Santos protected while avoiding authorities due to a false I.D.  He was convicted by a Dominican Republic court back in 1988, and served one year, a slap on the wrist for shooting my father to death. That's it.  After years of seeking justice for my family, Justo Santos was found living in Miami in 2012. He confessed and was indicted for murder in the second degree and criminal possession of a weapon in the second degree by a grand jury in New York, in June of 2013.

This killer intentionally hid from the justice system by fleeing for years after committing a serious and violent crime and now he is acting like the victim. It hurts me to have witnessed Judge Robert M. Stolz dismiss the grand jury’s indictment on October 30th, and to have watched my mom watch as his handcuffs were taken off - the man that killed her husband and destroyed her business.
