DA Mark Skurka: Do Not Let Missy be Returned to Her Abusive Owner

The Issue

On Dec. 8, 2015 Herman Lee Wright, Jr. was videotaped by a neighbor as he repeatedly hit his dog Missy.  In the video you can hear Missy screaming out in pain.  This video was shared widely via social media resulting in numerous calls to Corpus Christi Police Department and Animal Care Services.

Doing their due diligence, officers responded to Mr. Wright's address along with volunteers from 'For the Love of Strays' to check on the welfare of Missy.  Mr. Wright refused to surrender Missy.  She was seized and taken into custody by CCPD and CCACS, where she remains until the upcoming custody hearing.

On December 10, 2015 Judge O'Hare  ruled that Missy would not be returned to Mr. Wright and would remain in the custody of Corpus Christi Animal Care Services, and  since having been under the care of Animal Services' care Missy has flourished..  It is the wish of the undersigned that she remain in this nurturing and loving environment until she is adopted by a loving family, free of the abuse to which she was subjected by Mr. Wright who has since filed an appeal to regain custody of Missy.

What Mr. Wright did is a clear violation of Loco's Law which made mistreatment to a Non-Livestock Animal a serious offence.Texas Statute 42.092 Cruelty to Non-Livestock Animal: (8) "Torture" includes any act that causes unjustifiable pain or suffering...and (8) (c)  An offense under Subsection (b)(1), (2), (7), or (8) is a state jail felony, except that the offense is a felony of the third degree if the person has previously been convicted two times under this section, two times under Section 42.09, or one time under this section and one time under Section 42.09.   Loco's law made such behavior punishable by a $10, 000 fine and up to two years behind bars.

We, the undersigned, ask 1) That Missy not be returned to Mr. Wright.  2.)  That Mr. Wright be charged for his ruthless actions, that were intentional as punishment for Missy escaping from her yard.  3.)  That Mr. Wright be prosecuted to the fullest extent of the law and, if convicted, be sentenced to the maximum punishment for his abhorrent behavior against Missy.  4.)  That Mr. Wright never again be allowed to have any animal in his possession. 5.) That Mr. Wright undergo mandatory anger management counseling.  6.)  That CPS do a welfare check on his children. 

Missy is a sentient being who feels both pain and fear and should be considered as more than just property.  No animal should be subjected to abusive human behaviors that intentionally cause pain and fear.  A loving home where she will be considered as a family member awaits Missy, but only she is not returned to the unfit environment from where she came.
