We the people demand that District Attorney Elton Mathis of Waller County Texas and Lt. Brian Nichols of the Division of Animal Control in Waller County, immediately remove all horses owned or in the possession of Kathie Digilio, DVM.

Horses on her property are witnessed to be in distress since before 2011. Horses are being neglected, abused and starved. Regardless of the fact Kathie Digilio is a Veterinarian, she has clearly demonstrated she is not capable or is unwilling to care for these horses properly.

Photographs with dates have been presented to Law Enforcement and Animal Control. The records of the Houston SPCA show the horses in obvious distress, poor health and in need of medical attention. The reports note the numerous visits to Digilio's property and the lack of Law Enforcement to enforce recommendations of seizure.

Neighbors, have watched the horses decline, suffer, struggle. They have witnessed no hay, open wounds with no treatment, downed horses, horses with buckets attached to their heads by way of baling twine and bungee cords, causing unnecessary injury and preventing them access to food and water. In horror they watch these horses slowly deteriorate because Waller County has failed to do their job and uphold the law. These same neighbors were sued by Kathie Digilio on November 20, 2014 for defamation, each served with a restraining order to silence them from speaking out against her and her cruel and neglectful acts against her horses. On March 9th the Judge in the 506th District Court ruled that the case be dismissed with Prejudice against Kathie Digilio. Attorneys Fees and Sanctions were ordered against Digilio, as no Defamation was found including statements such as "The horse abusing Vet is moving horses in the middle of the night".

People have been and are willing to step up and foster, care for and adopt these horses. This situation has been reported to the SPCA over and over for years as shown in the SPCA records (187 pages of reports and 950+ photos) obtained by subpoena and filed with the Waller County Courts by Christin McCumber and her Attorney Jeffrey Dorrell. This case has been covered by the media and documented very clearly with dated photographs. We are requesting the horses be seized and cruelty charges be filed immediately.

This has gone on long enough.
