INTERAKSYON.COM FILE PHOTO InterAksyon.com The online news portal of TV5 MANILA - The Supreme Court (SC) will proceed with the oral arguments scheduled at 2 p.m. today, Tuesday, on the controversial Torre de Manila case despite an earlier plea by the Office of the Solicitor General (OSG) seeking another date for the hearing. In a post on its Twitter account, the SC Public Information Office said the oral arguments will push through as scheduled. "Oral argument in KoR (Knights of Rizal) vs DMCI will proceed at 2 p.m. today for petitioner's arguments, arguments for respondents to be heard on August 4," the SC PIO said. Solicitor General Florin Hilbay earlier asked the High Tribunal for the second time to reset the July 21 oral arguments on the case. In a 12-page petition, Hilbay pleaded for more time to prepare for the oral arguments since he had just arrived from the oral arguments at The Hague in the Netherlands, where he defended before an international tribunal the Philippines' claim over the West Philippine Sea against China. Instead of July 21, Hilbay pleaded with the High Tribunal for an “additional period of 30 days from July 15, or until August 15, within which to submit the required position paper and another 30 days from July 21 to adequately prepare for the oral arguments.” The SC earlier granted the OSG’s petition to reset the oral arguments from its original date of June 30 to July 21, with Hilbay also citing their preparation then for the oral arguments in the Arbitral Tribunal. The SC in an advisory last Tuesday has tapped three experts: Architect Emmanuel Cuntapay of the Department of Public Works and Highways (DPWH), an expert on the National Building Code as designated by the DPWH, and another from the Housing and Land Use Regulatory Board (HLURB) as “amici curiae” for the oral arguments. In the same advisory, the High Tribunal also allowed for the first time in its history “non-interested parties” to submit their positions on the case by way of briefs. The SC last month issued an injunction against the Torre de Manila project of DMCI Homes Inc. based on a petition filed by the Knights of Rizal which argued that it marred the view of the Rizal Monument in Luneta Park.
