Lito Atienza ang sobrang pananahimik ng mga konsehal ng Maynila sa kontrobersyal na usapin ng Torre de Manila, ang tinaguriang “pambansang photo bomber” sa monumento ni Gat Jose Rizal sa Luneta. Kaya naman ang nais ni Atienza ay painitin pa ang pamamahiya sa aksyong ito ng Manila City Council na siyang nagbigay ng ‘go signal’ para maitayo ang natu­rang gusali na agaw-eksena sa likod ng rebulto ng Pambansang Bayani, sukdulang sagasaan ng kanilang ordinansa ang zoning permit restrictions na umiiral sa naturang lugar. Ayon pa sa dating alkalde, lumagpas sa kanilang kapangyarihan ang mga konsehal at umasta na kasing bigat ng awtoridad ng “executive branch” ng lungsod nang aprubahan ang kons­truksyon ng DMCI sa kontrobersyal na gusali. Ayon kay Atienza, sumige pa rin ang Manila City Council kahit na alanganin at lilitaw na masyadong halata ang magiging pagsagasa sa zoning permit restrictions. “Contrary to their claims, the accountabi­lity for allowing the cons­truction of the Torre de Manila lies squarely with the City Councilors who approved it, despite their having flip-flopped and raised earlier objections,” pahayag nito. Wala na aniyang iba pang itinuturo sa kapalpakan kundi ang City Council ng Maynila dahil ito ang nagbigay ng go-signal para maiarya ang naturang proyekto. “Ordinance 8119 adopting the Manila Comprehensive Land Use Plan and Zoning Regulations of 2006 is clear. Section 63 provides that ‘... all land developers... shall secure a zoning permit from the City Planning and Development Officer for all conforming uses and, in cases of variances and exceptions, from the Sangguniang Panglungsod as per recom­mendation from the Manila Zo­ning Board of Adjustments and Appeals (MZBAA) through the Committee on Hou­sing, Urban Development and Resettlements prior to any construction’. Nowhere in the ordinance does it say that the City Council can automatically grant exceptions to the rule and that all building projects in the city should pass through the Council, as what it is doing right now. They abused the good intentions of the ordinance and used it to suit their own purpose,” paghimay pa ni Atienza. Ipinunto pa ng mam­babatas na nauna nang binasted ng City Council ang proyekto dahilan sa isinasaad ng Ordinance 8119 kung saan pinahihintulutan lamang para sa maximum floor area ang sukat na 27,000 square meters pero ang DMCI project ay may kabuuang floor area na 97,000 square meters na mas malaki ng tatlong ulit sa itinakdang limit. Kaya nagtataka si Atienza kung bakit naiba ang pasya sa huli, “What prompted the Councilors to finally approve the Torre de Manila despite this very clear violation of the ordinance?” Samantala, natawa si deputy presidential spokesperson Abigail Valte sa suhestiyon na ang rebulto na lamang ni Rizal ang ikutin bilang solusyon sa problema ng Torre de Manila. “Siguro hindi ho naman dapat ‘yung monument ni Rizal ‘yung galawin natin para lang umayos doon, ‘di ba? Let’s leave the monument be,” pahayag ni Valte. Matatandaang ipinanukala ni Manila Rep. Amado Bagatsing na ang monumento ng Pambansang Bayani na lang ang pihitin para imbes na nakaharap ito sa dagat at sa “most beautiful sunset in the world” ay haharap na ito sa Torre de Manila nang sa gayon ay hindi na umano magiging “photo bomber” nasabing high-rise building.
