The Issue
A number of concerned owners (more than 34) confirmed support to demand a Special General Meeting due to the following actions from the current Board of Trustees (BOT)
* The current BOT is not acting in the best interest of the 134 owners due to dereliction of their duties that places the owners at immense financial risk.
* The court case against Mrs. Maringa for overcrowding of Stand 99, was withdrawn during the time she was the vice Chairperson of the BOT and had the ability to unduly influence the decision to withdraw the case resulting in the owners now being liable to pay the R40k in Legal fees that only benefits Tsakani Maringa.
*Various owners requested the BOT minutes of meeting minutes to enable them to understand decisions made by the Trustees on their behalf. These requests have not been adhered to at all.
*The Site Development plan is outdated and the BOT has not done anything to update the plans.
*The Code of Conduct that has been updated but no meeting scheduled for its approval.
* The BOT neglected to approve the repairs to the weirs and pipes of the swimming pool for 3 months. The BOT was made aware of the acute dolomite risk to the homeowners of Die Hoewes. The deliberate delay resulted in the leaking of 70 900 litres of water in March and April 2022, 45 000 litres in May and 60 000 litres in June before it was attended to last week. The owners also need to pay for the wasted 175 000 + litres of water that was wasted and significantly increased the probability of sink holes on the property.
*The Tree project was documented and presented to the BOT and quotes provided in February 2022. The BOT again delayed approval for this critical project. This delay now causes additional damage to walls showing huge cracks and the damage is still increasing.
*The Chairperson and the Vice Chairperson embarked on a witch hunt by issuing 13 charges dating back between 7 and 5 months directed at the General Manager. This is the same person who had to perform the duties of both maintenance and Estate manager due to the 3 month delay by the BOT to make a suitable appointment.
Should the Trustees lose the case and it is referred to the CCMA, the owners will be liable for any financial award made by the CCMA.
*Many Owners and several previous Trustees indicated their willingness to testify against the vested BOT members at the disciplinary hearing.
The poor work conditions (victimization) and excessive working hours required of Estate manager that is way outside basic conditions of employment.
The listed Owners demand a Special General Meeting to be scheduled in the next 14 days to Level a Vote of no Confidence at the Trustees. Please confirm your receipt of this email. The supporting list can be confirmed with me.
