Brenda Guzman-Sandoval (A#205324750) arrived to the U.S. when she was 6 years old. She is now 22, married, and mother of five U.S. citizen children. She was in the process of registering for her GED classes at and apply for Deferred Action for Childhood Arrivals (DACA) when she was placed in deportation proceedings.
Immigration officials won't give her the chance to go before a judge, and that her last day in the U.S. will be this Thursday April 4th. She has now been given a week as her case is currently being revised.
Unemployed and facing the eviction of her and her family, she desperately turned to a pay day lender. After she fabricated a social security number, the pay day lender turned Brenda in to the police. She plead guilty to two misdemeanors for attempted identity fraud and attempted possess forgery writing/device, and was placed into a work diversion program.
On March 21, 2013, Brenda was being evicted from her home, the landlord called the sheriff to enforce the eviction. When the sheriff radioed her information there was a warrant out for her arrest, as she had failed to appear in court twice. Brenda implored the sheriff to call her probation officer and look at her documents of the work diversion program. The sheriff refused to do either and arrested her in front of all her crying children, and later turned her over to Immigration & Customs Enforcement (ICE).
Although the charges she pled guilty to are non-violent misdemeanors, ICE considers one an aggravated felony for purposes of immigration. The ICE local office has refused to listen to concerns from the community. They have a quota of 400,000 deportations each year. But Brenda's community is supporting her. Her mother and father has been at the forefront of reaching out to community organizations to stop her deportation.
Brenda has enrolled in the GED program at the Utah County Facility. If released and granted a Stay of Deportation, she would be given a chance to be with her children again and possibly apply for DACA. ICE has the ability to stop her deportation, to not separate her from her children, and to determine that she is DACA eligible, but they have ignored the requests.
