The DEA and HHS are proposing to reschedule cannabis to Schedule III using an eight-factor analysis. While this might seem like progress, it’s not enough. Rescheduling still limits access and keeps control in the hands of big pharma. We need cannabis to be decontrolled (descheduled) entirely.
Key Points to Make:
1. Attorney General's Power: Under 21 U.S.C. 811(a), the Attorney General has the authority to decontrol cannabis entirely.
2. Historical Support for Decontrol (Deschedule): The Shafer Commission, Francis Young (Former DEA Chief Administrative Law Judge), and the LaGuardia Report all advocated for decontrolling cannabis.
3. Eight-Factor Analysis: The DEA and HHS's own analysis highlights the lower abuse potential, significant medical benefits, and minimal public health risks of cannabis, which support decontrolling rather than rescheduling.
