The undersigned students, alumni, and educators of Stanford University, write to condemn the open sedition against the United States of America by Senator Josh Hawley of Missouri (Stanford University, AB, History, 2002).

We fully endorse the January 1, 2021 letter from Yale Law School Community and the statements from Stanford leadership condemning Senator Hawley’s recent actions.  The events of January 6, 2021 compel us not only to join those statements, but to add our own voices in condemning in the strongest possible terms the actions of Senator Hawley.

In their January 1 letter, the Yale Law School Community wrote that “while Senator Hawley’s effort [objecting to the results of the 2020 Presidental election]  is obviously doomed to failure, it is still a bare-faced assault on our democracy and a contemptible gesture toward a coup d’etat by President Donald J. Trump and his supporters.”

The armed insurrection against the Capitol on January 6 was not a mere gesture toward a coup d’etat, but an actual attempted coup. Senator Hawley bears direct responsibility for that coup, including the injuries and death that occurred. A well publicized photo of Senator Hawley shows him giving a raised fist salute to the armed insurrectionists just before the rioting and invasion of the Capitol began.

18 U.S.C. § 2384 defines seditious conspiracy as follows:

  • If two or more persons in any State or Territory, or in any place subject to the jurisdiction of the United States, conspire to overthrow, put down, or to destroy by force the Government of the United States, or to levy war against them, or to oppose by force the authority thereof, or by force to prevent, hinder, or delay the execution of any law of the United States, or by force to seize, take, or possess any property of the United States contrary to the authority thereof, they shall each be fined or imprisoned not more than 20 years, or both.

We call upon law enforcement authorities to investigate Sen. Hawley for engaging in seditious conspiracy, along with the other Senators and Representatives who actively encouraged the invasion of the Capitol on January 6, 2021.

We further call upon Sen. Hawley to resign his Senate seat. His continued role in public life presents a clear and present danger to American democracy.

Finally, we call upon Stanford University, to the maximum extent possible, to sever all ties with Sen. Hawley.
