Denial of Transfer Certificate (TC) By Indian Public School

The Issue

Hi All,

Sub:- Denial of TC by Indian Public School for a 1st standard school kid. Asking for a ransom for issuing the same.


With due respect I want to state the following. 


1.    My daughter recently passed her 1st standard from Indian Public School Jeevan Bhima Nagar.


2.    My father is a health patient and undergoing treatment from Delhi Heart Hospital, Delhi. Because of his bad health I had to quit my job to spend time with him.


3.    Since I had to resign from my current job and look for another job in Delhi/Nearby, I requested the school principal to issue a TC (transfer certificate) for my daughter.


4.    The result was announced on 5th April and we approached school principal for TC on the same day (we had informed to class teacher and other staff members much in advance that we need TC).


5.    However even after visiting the school couple of times, I was unable to get the certificate issued. Initially the principal denied to meet and after much efforts when we could make to meet her today, we were clearly denied to get the TC. Infact she asked us to deposit 1st term fee + other hidden charges if we need TC.


6.    Principal behavior was unacceptable and the language used by her doesn't suit a school principal.


7.    At the time of admission, we had paid a refundable security deposit which was to be returned at the time of leaving the school.

P.S.    All past fees and other demands have been paid till date (5th April 2019).


I request you all to help me in getting the TC and security deposit.


Kindly note getting the Transfer Certificate is a legal right of any student in India as mentioned by chief justice Justice N. Seshasayee. 


“No school has any authority to deny the issuance of the transfer certificates and other documents when the children opt to move to other schools... If at all there exists any legitimate claims against the parents, the school has to move the civil court for realising the same but the future of the children should not be held to ransom on this score,” he held.
