RE: REQUEST FOR INVESTIGATION AND ACCOUNTABILITY INTO UNAUTHORISED DEVELOPMENTS IN MABELREIGN AND SURROUNDING AREAS

SUMMARY OF COMPLAINT
This petition is brought against Denford Ngadziore who is the Harare Ward 16 Councillor and Chair of the SMEs Committee and Mr F. Manyika, Managing Director of Cartin Mark Up Investments (Pvt) Ltd (Arise and Shine) in relation to unlawful developments carried out in Mabelreign and surrounding areas.
The site behind ZESA offices in Mabelreign is a designated public car park. No Full Council Resolution has been produced authorising a change of land use. In law, the land therefore remains a car park and no development including temporary structures is permitted without such approval.
Residents engaged existing shop owners at Mabelreign Shopping Centre who confirmed that they were not notified of any proposed change of use and were not consulted despite being directly affected stakeholders. This confirms that statutory and administrative procedures were not followed.
Documentation submitted to Council shows that the proposal by Cartin Mark Up Investments was for a temporary market facility considered at SMEs Committee level under the chairmanship of Councillor Ngadziore. However, this proposal was not approved by Full Council and remained pending.
Despite this, permanent brick-and-mortar structures were constructed on site by Mr F. Manyika and his company, under the oversight of Councillor Ngadziore. This represents:
• Unlawful use of land (no change of use)
• Implementation without Full Council approval
• Material deviation from the approved temporary proposal
The subsequent demolition of the structures confirms that the development was not lawful. The issue now is how such an unlawful project was allowed to proceed.
Residents submit that this matter raises serious concerns regarding:
• Abuse of office
• Failure of oversight
• Possible circumvention of Council procedures
• Irregular implementation by a private developer
RELIEF SOUGHT
Residents respectfully demand the following:
1. Submission of all approvals and records (Within 72 Hours)
Harare City Council must produce all resolutions, approvals and administrative records relating to the developments.
2. Disclosure of procurement, allocation, and ownership (Within 5 Days)
Full disclosure of:
• Contractors and developers
• Allocation processes
• Financial and ownership arrangements
3. Formal Investigation by ZACC (Within 7 Days)
ZACC must investigate:
• Councillor Denford Ngadziore for possible abuse of office and irregular approval processes.
• Mr F. Manyika and Cartin Mark Up Investments for implementing a project without lawful authority and deviating from the approved scope.
4. Determination of Accountability (Within 14 Days)
Authorities must determine:
• Who authorised or allowed construction
• Whether any parties benefited directly or indirectly
• Whether due process was bypassed
5. Expanded Review of Related Projects
A broader review of developments under the Councillor’ Ngadziore’s oversight to determine whether a pattern of irregular conduct exists.
FINAL POSITION
• The land remains a car park. No lawful change of use was approved.
• Even the proposal for temporary structures had no full Council approval.
• Permanent structures were nevertheless constructed and later demolished.
This sequence confirms illegality and necessitates full investigation and accountability.
