Demolished by Corruption: Bengaluru demands accountability and justice from the government

This culture of rampant corruption, lawbreaking and malgovernance is killing Namma Bengaluru and affecting lakhs of hardworking citizens and their families; and this needs to stop! We require your intervention in ensuring this.

A large number of hardworking innocent homebuyers have paid the price, lost their homes and life time savings due to Bruhat Bangalore Mahanagara Palike’s (BBMP) recent demolition drive. Bengalureans are bearing the cost of corruption and negligence while Builders, layout Developers and Officials who were complicit with them in these rampant violations of law are untouched.

It is the obligation of the Government to regulate builders and be responsible for surveillance of illegal, lawbreaking constructions and stop them before they are sold to homebuyers who are innocent victims of builders and layout developers. Many homebuyers have invested their life’s savings on the basis of BBMPs plan approvals and it is a legitimate expectation therefore that citizens will be protected by the Government; hence we demand accountability and justice from the Government!

We would like you to urgently consider the following requests from citizens and residents of our city.

  1. No double standards in demolishing illegal constructions, where rich and well connected are excluded. 
  2. Prosecution without exception of All Guilty Government Officials and Erring Builders under all relevant sections of all Laws Violated.
  3. Compensation on Humanitarian grounds to the victims and the displaced who have homes with BBMP plan approvals.

While helpless homeowners have had their homes demolished and reclaimed by the Government, visible large projects that have blatantly violated laws and encroached on public lands remain untouched in the form of several malls, IT parks etc. That the Government of Karnataka, BBMP and Revenue Department are practicing double standards in the drive on illegalities is clear to all. The helpless individual remains the only victim while the rich and powerful continue to go scot free and enjoy the benefits of their illegal actions.

The plight of the citizenry who stand to lose out, upon demolition actions being undertaken, not for any fault of theirs but due to the limitless greed of certain builders and real estate agents is visible. Our belief in the Government stands shaken as we have fallen prey after investing our entire life’s savings in these properties which are now termed illegal.

It is on humanitarian grounds that we urge the Hon'ble Chief Minister to devise some mechanism to grant compensation such that all of us - affected families receive beneficial assistance from the State in such a time of crisis. The Government can generate these funds from penalizing the builders who were responsible for these projects. 

We request you to consider certain observations and suggestions made by the Hon’ble Apex Court in 2004 in Friends Colony Development Committee v. State of Orissa & Ors., (2004) 8 SCC 733, whereby the Court has urged the States to create a welfare fund out of heavy penalties which may be imposed on unscrupulous builders who have misused the trust of unsuspecting buyers and at times actively deceived or cheated them.

Most importantly, it is well known that serious collusion of high ranking officials in the government results in such rampant illegalities being perpetrated. These facts require a thorough investigation as to how government servants could turn a blind eye and be complicit to such extensive violations of law. 

In the interest of the City and its people, we urge you to initiate an urgent inquiry into the matter, identify the government and public servants whose actions and omissions are culpable and launch criminal prosecution so that all erring and corrupt government servants and all guilty real estate developers/builders are brought to justice.
